Board Resolution No. 103/2022

The Board of Directors of the Central Bank of Bolivia modifies the variable commission for USD cash withdrawals from the BCB vault, increasing the rate from 0.10% to 0.20% effective November 16, 2022. This adjustment to the 2022 Service Commission Table is implemented to cover the costs of importing US Dollars. The Presidency and General Management are tasked with executing and ensuring compliance with this resolution.

BOARD RESOLUTION NO. 103/2022

SUBJECT: TREASURY MANAGEMENT - MODIFY THE COMMISSION TABLE FOR BCB SERVICES FOR THE 2022 MANAGEMENT PERIOD.

VIEWED:

  • The Political Constitution of the State of February 7, 2009.
  • Law No. 1670 of October 31, 1995, of the Central Bank of Bolivia (BCB).
  • The BCB Statute approved by Board Resolution No. 095/2022, of October 6, 2022.
  • Board Resolution No. 146/2021 of December 21, 2021.
  • Technical Report BCB-GTES-SAMM-DAMM-INF-2022-119 of November 4, 2022, from the Treasury Management (GTES).
  • Legal Report BCB-GAL-SANO-DLBCI-INF-2022-231 of November 4, 2022, issued by the Legal Affairs Management (GAL).

CONSIDERING:

That Article 327 of the Political Constitution of the State states that the BCB is a public law institution, with legal personality and its own assets.

That Article 328 of the Political Constitution of the State establishes that among the attributions of the Central Bank of Bolivia is to execute exchange rate policy.

That Article 3 of Law No. 1670, modified by Article 67, section A3, numeral 1 of Law No. 1864 of June 15, 1998, establishes that the BCB, within the framework of the Law, will formulate policies of general application in monetary, exchange rate, and payments system matters, for the fulfillment of its object.

That Article 44 of Law No. 1670 establishes that the highest authority of the BCB is its Board of Directors, which is responsible for defining its policies, specialized regulations of general application, and internal rules.

That subsections a), c), and q) of Article 54 of Law No. 1670 provide that the Board of Directors has within its attributions to issue rules and adopt general decisions that are necessary for the BCB to fulfill the functions, competencies, and powers assigned to it by the Law; as well as to monitor the execution of monetary, exchange rate, credit, financial intermediation, international reserves administration, and other policies and regulations corresponding to the BCB under this Law; and those others indicated by the Law and those necessary for the fulfillment of its functions.

That numeral 44) of Article 10 of the BCB Statute approved by Board Resolution No. 095/2022, provides that the Board of Directors has the attribution to set the Commission Table that the BCB must charge for the services it provides.

That GTES, through Technical Report BCB-GTES-SAMM-DAMM-INF-2022-119, concludes that it is necessary to increase the commission for: Withdrawal of cash in USD from the BCB vault currently in effect for the 2022 management period, in order to cover the costs of importation in US Dollars. Consequently, GTES recommends the modification of the "Commission Table for Services for the 2022 management period," approved by Board Resolution No. 146/2021 of December 21, 2021, recommending to the BCB Board of Directors its approval.

That GAL, through Legal Report BCB-GAL-SANO-DLBCI-INF-2022-231, concludes that the GTES proposal is appropriate, recommending to the BCB Board of Directors the approval of the modification of the Commission Table for Services for the 2022 management period requested by GTES.

THEREFORE,

THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF BOLIVIA

RESOLVES:

Article 1.- Modify the variable commission, from 0.10% to 0.20%, of numeral 11 of the "BCB Service Commission Table - 2022 Management Period," approved by Board Resolution No. 146/2021 of December 21, 2021.

Article 2.- The modification to the "Service Commission Table - 2022 Management Period" will enter into force as of November 16, 2022.

Article 3.- The Presidency and General Management are charged with the execution and compliance of this Resolution.
