Board Resolution No. 140/2017

The Board of Directors of the Central Bank of Bolivia amends Article 8 of the Internal Regulations for operations through the SUCRE system. The modification authorizes payments originating from Letters of Credit issued by SUCRE member countries and Payment Orders issued between Ecuador and Bolivia.

BOARD RESOLUTION NO. 140/2017

SUBJECT: INTERNATIONAL OPERATIONS MANAGEMENT – APPROVES MODIFICATION TO THE INTERNAL REGULATIONS FOR OPERATIONS THROUGH SUCRE.

VIEWING:

  • Law No. 1670 of October 31, 1995 of the Central Bank of Bolivia.
  • The Statute of the BCB approved by Board Resolution No. 128/2005 of October 21, 2005 and its subsequent modifications.
  • The Constitutive Treaty of the Regional Payment Compensation Unitary System (SUCRE) signed on October 16, 2009.
  • Board Resolutions Nos. 103/2010, 113/2010, 196/2012 and 070/2013 of September 14, 2010, October 5, 2010, November 20, 2012 and June 25, 2013 respectively.
  • The report from the International Operations Management BCB-GOI-SOEXT-DOCC-INF-2017-11 of October 3, 2017.
  • The report from the Legal Affairs Management BCB-GAL-SANO-DLBCI-INF-2017-279 of October 6, 2017.

CONSIDERING:

  • That by Board Resolution No. 103/2010, the Internal Regulations for operations through SUCRE were approved.
  • That by Board Resolutions No. 113/2010, No. 196/2012 and No. 070/2013, modifications to the Internal Regulations for operations through SUCRE were approved.
  • That the report BCB-GOI-SOEXT-DOCC-INF-2017-11 from the International Operations Management recommends that modifications be made to the aforementioned Regulations.
  • That the report BCB-GAL-SANO-DLBCI-INF-2017-279 from the Legal Affairs Management states that there is no legal impediment for the Board to consider the modification to the Internal Regulations for operations through SUCRE.
  • That in accordance with Article 54 subsection o) of Law No. 1670 and Article 11 numeral 29) of the BCB Statute, the Board is authorized to approve, interpret and modify the Statute and Regulations of the Institution by two-thirds of the votes of all its members, without the need for any additional administrative act.

THEREFORE,

THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF BOLIVIA

RESOLVES:

Article 1.- Modify Article 8 (Authorized Instruments) of the Internal Regulations for operations through the Regional Payment Compensation Unitary System (SUCRE).

IT SAYS:

Payments originating from Letters of Credit are authorized.

IT MUST SAY:

“Payments originating from Letters of Credit issued by the member countries of SUCRE and Payment Orders issued between Ecuador and Bolivia are authorized.”

Article 2.- The Presidency and General Management are charged with the execution and compliance of this Resolution.
