Board Resolution No. 146/2021

The Board of Directors of the Central Bank of Bolivia approves the 2022 Service Commission and Fine Tables, establishing specific fees for international transfers, foreign trade operations, cash deposits and withdrawals, and transactional services for financial entities. These regulations take effect on January 1, 2022, and simultaneously repeal the previous 2021 commission and fine tables approved by Resolutions No. 143/2020 and No. 042/2021.

BOARD RESOLUTION NO. 146/2021

SUBJECT: GENERAL MANAGEMENT – MODIFY THE TABLE OF COMMISSIONS FOR SERVICES OF THE CENTRAL BANK OF BOLIVIA FOR THE 2022 FISCAL YEAR.

VIEWED:

  • The Political Constitution of the State (CPE), of February 7, 2009.
  • Law No. 1670 of October 31, 1995, of the Central Bank of Bolivia (BCB).
  • The BCB Statute approved by Board Resolution No. 128/2005 of October 21, 2005, and subsequent modifications.
  • Board Resolution No. 143/2020 of December 15, 2020, which approves the Table of Commissions for Services and the Table of Fines of the BCB for the 2021 fiscal year.
  • Board Resolution No. 042/2021 of March 9, 2021, which modifies the Table of Commissions for Services and the Table of Fines of the BCB for the 2021 fiscal year.
  • The Report from the International Operations Management BCB-GOI-INF-2021-27 of December 6, 2021.
  • The Report from the Legal Affairs Management BCB-GAL-SANO-DLBCI-INF-2021-244 of December 14, 2021.

CONSIDERING:

  • That the Political Constitution of the State, in its article 327, determines that the BCB is a public law institution, with legal personality and its own assets. Within the framework of the State's economic policy, it is the function of the BCB to maintain the stability of the internal purchasing power of the currency, to contribute to economic and social development.
  • That according to article 54, subsection n) of Law No. 1670, it is the responsibility of the Board of Directors to formulate policies regarding the internal management of the BCB, supervising their execution.
  • That according to article 11, numeral 45) of the BCB Statute, the Board of Directors has among its powers the authority to set annually the Table of Commissions to be charged for the services it provides.
  • That the Economic Policy Advisory (APEC) and the International Operations (GOI), Treasury (GTES), Monetary Operations (GOM), Financial Entities (GEF), and Administration (GADM) Management departments, through Report BCB-GOI-INF-2021-27 of December 6, 2021, establish the need for approval of the Table of Commissions for Services and the Table of Fines of the Central Bank of Bolivia for the 2022 fiscal year.

That the Report BCB-GAL-SANO-DLBCI-INF-2021-244 from the Legal Affairs Management (GAL) states that what is established in the technical report does not contravene current legal regulations, being the competence of the BCB Board of Directors to consider its approval in accordance with what is established in article 54 subsections a) and n) of Law No. 1670 and articles 11 numeral 45), 24 and 26 of the BCB Statute.

THEREFORE,

THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF BOLIVIA

RESOLVES:

Article 1.- Approve the Table of Commissions for Services and the Table of Fines of the Central Bank of Bolivia for the 2022 fiscal year, which forms part of this Resolution as an annex.

Article 2.- This determination shall enter into effect from January 1, 2022.

Article 3.- Board Resolution No. 143/2020 of December 15, 2020, and the modification approved by Board Resolution No. 042/2021 of March 9, 2021, are hereby repealed.

Article 3.- The Presidency and General Management are charged with the execution and compliance of this Resolution.
