Bangladesh Bank Chief Executive Office Motijheel, Dhaka-1000 Bangladesh Ref No.: BRPD-Circular-58 Banking Regulation and Policy Department BRPD Circular Letter No. 58 30 Kartik 1430 Date: --------------------- 15 November 2023 Managing Director / Chief Executive Officer All Scheduled Banks Operating in Bangladesh Dear Sir,
With reference to the matter of taking measures for the timely disposal of pending cases in the Artha Rin Adalat, your attention is drawn to the following:
Separate courts have been established for the speedy disposal of Artha Rin cases through the Artha Rin Adalat Act, 2003, and there is a legal obligation to dispose of cases according to the time-bound procedure.
Recently, it has been observed by Bangladesh Bank in the review of judgments and orders of various Artha Rin cases that the disposal of Artha Rin cases is taking much more time than expected, which is harming the interests of both depositors and scheduled banks. Long delays in case disposal have been observed, particularly due to the negligence of all parties in the case, especially the plaintiff banks, in the efficient management of the cases, which is undesirable.
In this context, you are advised to manage the cases with maximum preparation by contacting the respective lawyers on the dates of hearing, with the aim of timely and efficient disposal of pending cases in the Artha Rin Adalat.
Yours faithfully, (Md. Harun-Or-Rashid) Director (BRPD) Phone: 9530095
