The Executive Committee of the National Securities Market Commission (CNMV) issued this agreement to revoke its previous decision from 5 October 2016 regarding the extraordinary delegation of its competencies. The revocation is necessitated by the recent appointment of the CNMV President and Vice President, which resolved the quorum issues that originally justified the delegation. This agreement enters into force upon its publication in the Official State Gazette.

The Executive Committee of the National Securities Market Commission (CNMV) is a body endowed with its own competencies conferred upon it by virtue of both Article 26 of the Consolidated Text of the Securities Market Law, approved by Legislative Royal Decree 4/2015, of 23 October (TRLMV), and the Internal Regime Regulation of the CNMV, approved by Council Resolution of 10 July 2003 and its internal regulations.
Recently, the President and Vice President of the CNMV were appointed by Royal Decree 567/2016, of 25 November, and Royal Decree 568/2016, of 25 November, respectively. Consequently, the difficulty that arose when adopting the Agreement of 5 October 2016 of the Executive Committee of the National Securities Market Commission on delegation of powers has been resolved.
With these appointments made, said Body can now achieve the quorum for constitution legally required; therefore, the delegation carried out on an extraordinary basis of some of the aforementioned competencies of the Executive Committee to the President and Vice President, or to the person who legally assumed their temporary substitution, is no longer necessary.
In accordance with the provisions of Article 26 of the TRLMV and Section 6 of Article 9 of Law 40/2015, of 1 October, on the Legal Regime of the Public Sector, the Executive Committee of the CNMV, in its session of 2 December 2016, has adopted the following agreement:
First. The Agreement of 5 October 2016, of the Executive Committee of the National Securities Market Commission, on delegation of powers, is revoked.
Second. This Agreement shall take effect from the day of its publication in the "Official State Gazette".
