Investment of Customer Funds by Futures Commission Merchants and Derivatives Clearing Organizations

The Commodity Futures Trading Commission issued a final rule amending regulations governing the types of investments that futures commission merchants and derivatives clearing organizations may make with customer funds. The amendments expand the list of permitted investments to include specific foreign sovereign debt, exchange-traded funds, and commercial paper, while also revising asset-based and issuer-based concentration limits. Additionally, the rule specifies market risk capital charges for new investments, updates reporting requirements for depositories, and eliminates the read-only electronic access mandate for customer fund accounts.
