Central Bank of Brazil Instruction Normative No. 756 Amending Instruction Normative No. 693 Regarding Virtual Asset Services Reporting

The Central Bank of Brazil issued Instruction Normative No. 756 to amend the effective date for reporting virtual asset services in the foreign exchange market from May 2026 to November 2026. This adjustment aligns the reporting obligations with the revised provisions of Resolution BCB No. 277, as modified by Resolution BCB No. 574, which mandates reporting for operations conducted on or after November 3, 2026. The regulatory impact analysis was waived because the amendment merely harmonizes procedural deadlines with higher-level norms without introducing new regulatory alternatives.

The Head of the Financial System Monitoring Department – Desig and the Head of the Prudential and Exchange Regulation Department – Dereg, in the exercise of the powers conferred upon them by Art. 23, item I, letter “a” of the Internal Regulations of the Central Bank of Brazil, published through Resolution BCB No. 340 of September 21, 2023, based on Arts. 85, item I, letter “b”, and 119, item II, letter “a”, respectively, of the aforementioned Regulations,

and considering the provisions of Resolution BCB No. 277 of December 31, 2022,

RESOLVE:

Art. 1º Instruction Normative BCB No. 693 of December 19, 2025, published in the Official Gazette of the Union - DOU on December 22, 2025, Section 1, p.447/448, shall be amended as follows:

“Art. 2º As established in Art. 82-A of Resolution BCB No. 277 of December 31, 2022, the information referred to in Art. 1, main text, items I to IV must be submitted to the Central Bank of Brazil starting from the reference date of November 2026:

Art. 2º This Instruction Normative enters into force on the date of its publication.

NOTE

  1. Instruction Normative BCB No. 693 of December 19, 2025, established the procedures for submitting information to the Central Bank of Brazil regarding the provision of virtual asset services in the foreign exchange market, starting from the reference date of May 2026, in line with Resolution BCB No. 277 of December 31, 2022.

  2. However, Resolution BCB No. 574 of June 18, 2026, amended the wording of Resolution BCB No. 277 of 2022 to establish that information regarding the provision of virtual asset services in the foreign exchange market shall only be sent to the Central Bank of Brazil for operations carried out from November 3, 2026.

  3. Decree No. 10,411 of June 30, 2020, regulates the conduct of regulatory impact analysis – AIR as a prerequisite for the issuance of normative acts. However, in its Art. 4º, the Decree establishes the hypotheses for dispensing with the AIR. This BCB Instruction Normative falls under the hypothesis provided for in item II – normative act intended to regulate rights or obligations defined in a hierarchically superior norm that does not technically or legally allow for different regulatory alternatives.

  4. In this sense, this Instruction Normative adjusts the initial deadline for sending information to the Central Bank of Brazil regarding the provision of virtual asset services in the foreign exchange market of the aforementioned Instruction Normative BCB No. 693 of 2025, to remain in harmony with the deadline defined by the current wording of Resolution BCB No. 277 of 2022, justifying its inclusion in item II of Art. 4º of Decree No. 10,411 of 2020.

  5. Thus, based on the provisions of paragraphs 3 and 4, we understand that the issuance of this Instruction Normative is exempt from conducting an AIR.
