CIRCULAR 11/2026 TO CREDIT INSTITUTIONS, REGULATED MULTIPLE-OBJECT FINANCIAL SOCIETIES THAT MAINTAIN EQUITY LINKS WITH CREDIT INSTITUTIONS AND THE NATIONAL FINANCIAL DEVELOPMENT INSTITUTION FOR AGRICULTURE, RURAL, FORESTRY AND FISHERIES:

SUBJECT: MODIFICATIONS TO CIRCULAR 3/2012 (OPERATING LEVELS OF DEMAND DEPOSIT ACCOUNTS)

The Bank of Mexico, with the purpose of continuing to promote the sound development of the financial system, fostering the proper functioning of payment systems, and protecting the interests of the public, considers it necessary to continue promoting the use and acceptance of digital payment methods. Therefore, it has resolved to increase the number of operating levels for demand deposit accounts denominated in national currency, so that users of the financial system have more alternatives that can adapt to their needs, while simultaneously incentivizing the use of electronic fund transfers and the acceptance of card payments.

For the above reason, based on Articles 28, paragraphs seventh and eighth, of the Political Constitution of the United Mexican States; 24 and 26 of the Bank of Mexico Law; 48 of the Credit Institutions Law; 22 of the Law for Transparency and Orderly Regulation of Financial Services; 1, 4, first paragraph, 8, paragraphs fourth and eighth, 10, first paragraph, 12 Bis, first paragraph, in relation to 20 Quáter, fraction IV, 14 Bis, first paragraph, in relation to 17, fraction I, and 14 Bis 1, first paragraph, in relation to 25 Bis 1, fraction IV, and 25 Bis 3, fraction II, of the Internal Regulations of the Bank of Mexico, which grant it the authority to issue provisions through the General Directorate of Payment Systems and Market Infrastructures, the General Legal Directorate, and the General Directorate of Financial System Affairs; as well as Second, fractions I, X and XVII, of the Agreement on the Affiliation of Administrative Units of the Bank of Mexico, it has resolved to modify Articles 4, 5, 8, 14, first and last paragraphs, 15, fraction II, 17, second paragraph, 17 Ter, fractions I and III, first paragraph, 24 Bis, fraction III, first paragraph, and 76, sixth paragraph; add the second paragraph to fraction II, and fraction II Bis to Article 14; as well as repeal the third paragraph of Article 14, of the "Provisions applicable to the operations of credit institutions, regulated multiple-object financial societies that maintain equity links with credit institutions, and the National Financial Development Institution for Agriculture, Rural, Forestry and Fisheries", contained in Circular 3/2012, as they have been reformed, to remain in the following terms:

PROVISIONS APPLICABLE TO THE OPERATIONS OF CREDIT INSTITUTIONS, REGULATED MULTIPLE-OBJECT FINANCIAL SOCIETIES THAT MAINTAIN EQUITY LINKS WITH CREDIT INSTITUTIONS AND THE NATIONAL FINANCIAL DEVELOPMENT INSTITUTION FOR AGRICULTURE, RURAL, FORESTRY AND FISHERY

"Authorizations Article 4th.- The authorization requests that Institutions submit to the Bank of Mexico in accordance with these Provisions shall be presented to the Central Bank Authorizations and Sanctions Directorate."

"Time Zone Article 5th - The schedules mentioned in these Provisions shall refer to the time zone of Mexico City, unless otherwise specified."

"Account Holders Article 8th.- Institutions may open Deposit Accounts denominated in national currency to natural and legal persons. Special savings accounts, as well as Accounts of levels 1, 2 and 2 Bis of Demand Deposits, may only be opened to natural persons.

Notwithstanding the foregoing, Development Banking Institutions may only open Accounts to natural persons in cases where their respective organic laws so establish."

"Operating Levels Article 14.- Demand Deposit Accounts shall be classified into five operating levels, depending on the requirements for the opening of the Account in question, in accordance with what is provided in the "General provisions referred to in Article 115 of the Credit Institutions Law" issued by the Secretariat of Finance and Public Credit, as they have been reformed or replaced.

… I. … II. ... In these Accounts, Institutions may receive additional monthly deposits up to the limit established in the previous paragraph, up to the equivalent in national currency to six thousand UDIS, subject to the condition that the origin of the additional resources comes exclusively from subsidies related to government support programs for certain sectors of the population. II Bis. In Accounts classified as level 2 Bis, the sum of credits during a calendar month may not exceed the equivalent in national currency to fifteen thousand UDIS, of which only the equivalent in national currency to three thousand UDIS may correspond to the receipt of resources in cash for credit to the Account. These Accounts may be opened exclusively by Mexican natural persons with residence in national territory. III. and IV. … Repealed. … To determine the maximum amount of credits in Accounts of levels 1, 2, 2 Bis and 3 during a calendar month, Institutions may not consider amounts related to interest, refunds for electronic fund transfers, and any other bonus that such Institutions perform for the use or management of the Account, if any, made during the period in question."

"Charges to Accounts Article 15.- … I. … II. With respect to Accounts of levels 2, 2 Bis, 3 and 4, through the means determined by Institutions, such as electronic fund transfers, including Direct Debit and debit cards. III. …"

"Electronic Fund Transfers Article 17.- … Without prejudice to the foregoing, Institutions may, in cases so determined, offer holders of Accounts of levels 2, 2 Bis, 3 or 4, the execution of other types of electronic fund transfers that such holders instruct against the respective Accounts. To carry out the aforementioned transfers, Institutions may allow such account holders to transmit the respective instructions through the equipment, means, systems and telecommunications networks that such Institutions determine in accordance with applicable provisions. In turn, only those Institutions that are participants in a payment system for electronic fund transfers executed on the same Banking Business Day of operation, among Demand Deposit Accounts, among others, in accordance with the applicable regulations for that system, may offer their clients the ability to transmit, through mobile devices, the respective instructions to perform transfers through that system, regardless of the communication channel used by the device to transmit the aforementioned instructions.

"Requirements for Electronic Fund Transfers Article 17 Ter.- … I. Institutions shall assign, at least, one CLABE to each Account of levels 2, 2 Bis, 3 and 4 that they keep open, as well as identify them with the sixteen reference digits of the corresponding valid debit cards for such Accounts, if any, that they have issued; II. … III. Without prejudice to what is established in fractions I and II above and subject to the terms and exceptions indicated below, the Institution that keeps Accounts of levels 2, 2 Bis, 3 or 4 open shall, at the request of the holder of the Account in question, associate with it the last ten digits of the number of a mobile phone line that they indicate, for the purpose of receiving, by credit to said Account, electronic fund transfers executed in accordance with Article 17. In turn, Institutions that keep level 1 Accounts open may, if they so determine, offer their clients, for the aforementioned purpose, the association of said mobile phone line digits indicated by the respective holders to such Accounts. … (i) to (viii) … IV. to XIII. …"

"Adolescent Deposit Accounts Article 24 Bis.- … I. to II. … III. In the case of those Deposits referred to in this article that correspond to Demand Deposits, the Accounts that Institutions open may only be of level 2, in accordance with what is established in Article 14 of these Provisions for this type of Deposit and, in this case, the additional limit of six thousand UDIS indicated in the second paragraph of fraction II of the aforementioned article shall not apply to them, with respect to credits of resources coming from subsidies related to government support programs for certain sectors of the population. … IV. to X. …"

"Processing of Requests Article 76. … I. to II. … … The Receiving Institution may process the request referred to in this article only if the Receiving Account designated by the account holder corresponds to a level 4 Account. Regarding Accounts of levels 2, 2 Bis and 3, the Receiving Institution that opens them may consider them as Receiving Accounts, provided that the Receiving Institution obtains from the respective account holders the documentation that, for level 4 Accounts, Institutions must obtain from their clients in accordance with what is established regarding this in the "General provisions referred to in Article 115 of the Credit Institutions Law" issued by the Secretariat of Finance and Public Credit. …"
