Circular 13/2008 — Modifies Circular 2019/95

The Bank of Mexico amends sections M.73.52 and M.73.54 of Circular 2019/95 to require multiple banking institutions to submit periodic information to the General Directorate of Central Banking Operations and the Financial System Information Directorate. Specifically, institutions must report fees and commissions charged for payment system services, including any proposed modifications, via the Financial Information Collection System (SAIF). These obligations apply to all multiple banking institutions in Mexico and take effect on April 25, 2008.

"2008, Year of Physical Education and Sport" CIRCULAR 13/2008 Mexico City, April 18, 2008. TO THE MULTIPLE BANKING INSTITUTIONS: SUBJECT: MODIFICATIONS TO CIRCULAR 2019/95.

The Bank of Mexico, based on what is provided in Article 28 of the Political Constitution of the United Mexican States, sixth and seventh paragraphs; Articles 24, 26, and 36 of the Bank of Mexico Law; Articles 21 and 22 of the Law for Transparency and Regulation of Financial Services; Articles 8th, third and fourth paragraphs, 10, 12 first paragraph in relation to Section IV of Article 20, and Section I of Article 17, which provide for the attribution of the General Directorate of Central Banking Operations and the Directorate of Central Banking Regulations to participate in the issuance of regulations, respectively, all from the Internal Regulations of the Bank of Mexico published in the Official Gazette of the Federation on September 30, 1994, whose last modification was published in said Official Gazette on April 26, 2007; with the object of promoting the sound development of the financial system and the protection of the interests of the public, by expanding the regime applicable to the information that such institutions must provide to this Central Institute, has resolved to modify numerals M.73.52., as well as M.73.54. first paragraph, of Circular 2019/95, to remain in the following terms:

M.73.5 INFORMATION TO THE BANK OF MEXICO.

“M.73.52. REPORTS TO THE GENERAL DIRECTORATE OF CENTRAL BANKING OPERATIONS AND TO THE FINANCIAL SYSTEM INFORMATION DIRECTORATE.

Institutions shall provide the General Directorate of Central Banking Operations, as well as the Financial System Information Directorate of the Bank of Mexico, with the periodic information that, within their respective areas of competence, these Directorates request from them. The aforementioned information shall be sent in the form and terms made known to them by said Directorates.

“M.73.54. REPORTS ON FEES AND COMMISSIONS.

Institutions shall send to the General Directorate of Central Banking Operations and to the Financial System Information Directorate of the Bank of Mexico, in the form that they make known to them, information regarding the fees and commissions they charge for various services related to payment systems, as well as the modifications they intend to make to said fees and commissions before applying or disseminating them. The aforementioned information shall be sent through the Financial Information Collection System (SAIF) in the form and terms, as well as with the advance notice and periodicity that said Directorates make known to them.

…” TRANSITIONAL PROVISION SOLE TRANSITIONAL PROVISION.- This Circular shall enter into force on April 25, 2008.
