Circular 27/2010 — Amending the Rules for Exchange Houses in Their Operations

This circular adds a second paragraph to sections 2.1 and 2.2 of the Rules for Exchange Houses, requiring them to comply with the General Provisions issued by the Ministry of Finance and Public Credit when receiving US dollars in cash for foreign exchange operations or for sending fund transfers. The amendments apply to exchange houses operating in Mexico and take effect on October 5, 2010.

TO EXCHANGE HOUSES:

SUBJECT: RESOLUTION MODIFYING THE RULES TO WHICH EXCHANGE HOUSES MUST ADHERE IN THEIR OPERATIONS

The Bank of Mexico, based on the provisions of Article 28 of the Political Constitution of the United Mexican States, sixth and seventh paragraphs; Articles 24, 26, and 32 of the Bank of Mexico Law; Article 84, fraction V of the General Law of Credit Auxiliary Organizations and Activities; Article 22 of the Law for Transparency and Orderly Regulation of Financial Services; Article 8, third and sixth paragraphs; Article 10, first paragraph; Article 14, first paragraph in relation to Article 25, fraction II; and Article 17, fraction I of the Internal Regulations of the Bank of Mexico, which grant it the authority to issue provisions through the General Directorate of Financial System Analysis and the Directorate of Central Bank Regulations, respectively; as well as the Sole Agreement on the Affiliation of the Administrative Units of the Bank of Mexico, fractions III and IV; and considering the modifications to the "General Provisions referred to in Article 95 of the General Law of Credit Organizations and Activities, applicable to Exchange Houses" made by the Ministry of Finance and Public Credit, published in the Official Gazette of the Federation on September 9, 2010, has resolved to add a second paragraph to numerals 2.1 and 2.2 of the "Rules to which exchange houses must adhere in their operations," to remain in the following terms:

RULES TO WHICH EXCHANGE HOUSES MUST ADHERE IN THEIR OPERATIONS

  1. OPERATIONS

"2.1 . . . The operations referred to in the aforementioned Article 81-A, fraction I, in which Exchange Houses receive US dollars in cash, must comply with the provisions of the "General Provisions referred to in Article 95 of the General Law of Credit Organizations and Activities, applicable to Exchange Houses" issued by the Ministry of Finance and Public Credit."

"2.2 . . . Exchange Houses must comply with the provisions of the "General Provisions referred to in Article 95 of the General Law of Credit Organizations and Activities, applicable to Exchange Houses" issued by the Ministry of Finance and Public Credit, when receiving US dollars in cash to carry out the service of sending fund transfers."

TRANSITORY SINGLE. This Circular shall enter into force on October 5, 2010.
