Circular 4/2023 — Modifications to Circular 3/2012 (Interbank Equilibrium Interest Rate for Terms Greater Than One Banking Business Day)

The Bank of Mexico modifies the methodology for calculating the Interbank Equilibrium Interest Rate (TIIE) for terms greater than one banking business day to ensure it is based on actual market transactions, restricting its use as a reference for new operations from specified dates. The circular repeals numerous articles and annexes from Circular 3/2012 that governed the previous determination and publication procedures, replacing them with a calculation formula based on the overnight interbank rate and the monetary policy target rate. CIRCULAR 4/2023 TO CREDIT INSTITUTIONS, REGULATED MULTIPLE-OBJECT FINANCIAL SOCIETIES THAT MAINTAIN EQUITY LINKS WITH CREDIT INSTITUTIONS AND THE NATIONAL FINANCIAL INSTITUTION FOR AGRICULTURAL, RURAL, FORESTRY AND FISHERIES DEVELOPMENT: SUBJECT: MODIFICATIONS TO CIRCULAR 3/2012 (INTERBANK EQUILIBRIUM INTEREST RATE FOR TERMS GREATER THAN ONE BANKING BUSINESS DAY)

The Bank of Mexico, with the purpose of continuing to promote the sound development of the financial system and considering the recommendations of the Swiss association that groups financial authorities from various countries, known as the Financial Stability Board (FSB, by its acronym in English), as well as of the grouping of banking supervisory authorities, known as the Basel Committee on Banking Supervision, and of the International Organization of Securities Commissions (IOSCO, by its acronym in English) regarding the characteristics that reference interest rates used in financial markets must meet, in particular, the periods during which financial institutions should cease to use reference rates not determined based on real transactions, has decided to determine the dates from which the use, as a reference for new operations, of the Interbank Equilibrium Interest Rate in national currency (TIIE) for terms greater than one banking business day will be restricted, as well as to modify the methodology for its calculation, so that it is carried out based on market facts.

For the above, based on articles 28, paragraphs sixth and seventh, of the Political Constitution of the United Mexican States, 24 and 26 of the Bank of Mexico Law, 48 of the Credit Institutions Law, 87-D, paragraph fourth, of the General Law of Organizations and Auxiliary Activities of Credit, 22 of the Law for Transparency and Ordering of Financial Services, 1, 4, first paragraph, 8, paragraphs fourth and eighth, 10, first paragraph, 12, first paragraph, in relation to 19 Bis 1, fraction XI, and 17, fraction I, of the Internal Regulations of the Bank of Mexico, which grant it the authority to issue provisions through the General Directorate of Central Bank Operations and the Directorate of Central Bank Provisions, respectively, as well as Second, fractions VI and X, of the Agreement on the Attachment of Administrative Units of the Bank of Mexico, has resolved to modify the Index, the definition of “TIIE for Terms Greater Than One Banking Business Day” contained in article 2°, articles 38, paragraph third, 115, fractions II and III, 116, fraction I, 150, 160 Bis, 192, paragraph third, 195 Bis 3, paragraphs first, fourth and sixth, as well as sub-paragraphs a) and b) of paragraph second, 195 Bis 4, paragraphs first and third, as well as fractions I and II, 195 Bis 5, paragraph first and fraction I, as well as Annexes 5, 5 Bis 1, 10, 11, 12 Bis, 12 Bis 1, 12 Bis 2, 12 Bis 3, 12 Bis 4 and 12 Bis 5, as well as repeal fraction I Bis of article 38, fraction IV of article 115, articles 146, 147, 148, 149, 151, 152, 153, 154, 155, 156, 157, 158, 159, 160, 161, 162, 163, sub-paragraph b) of fraction VI of article 188, sub-paragraph b) of fraction II of article 195 Bis 5, as well as Annexes 12, 12 Bis 6 and 12 Bis 7, of the “Provisions applicable to the operations of credit institutions, regulated multiple-object financial societies that maintain equity links with credit institutions and the National Financial Institution for Agricultural, Rural, Forestry and Fisheries Development”, contained in Circular 3/2012, to remain in the following terms:

“Determination of the value of the Special Guarantees that must be constituted by Institutions

6 OFFICIAL GAZETTE Thursday, April 13, 2023 Article 195 Bis 4.- The Bank of Mexico will calculate, on each Banking Business Day, the total value of the Special Guarantees that Institutions must constitute for the guarantee fund in order to cover, if applicable, the write-downs of Dollar Deposits granted in pledge or of Titles granted in stock pledge based on the following: I. In the case of credits guaranteed with Dollar Deposits: The difference between (i) the value in Mexican pesos of the Dollar Deposits delivered in pledge in the credit operation celebrated by the Institution in question in terms of article 188 of these Provisions, at the exchange rate published by the Bank of Mexico in the Official Gazette of the Federation on the day of the corresponding valuation, applying the discount factor that will be made known through the SAGAPL, taking as base the procedure described in said article, and (ii) the sum of the principal of said credit plus the estimated interests corresponding to the credit referred to in the cited article 188. II. In the case of repos: The difference between (i) the value in Mexican pesos of the titles granted in stock pledge and the titles object of the repo celebrated by the Institution in question in terms of article 189 of these Provisions, taking as base the procedure described in Annex 7. The referred value will be calculated applying the prices and discount factors that will be made known through the SAGAPL on the day of the corresponding valuation, and (ii) the sum of the price plus the premium or estimated premium, as applicable, of the repo in question. … The Special Guarantees that the Institution constitutes must cover at all times, at least the added value of the write-downs that all dollar deposits and titles object of repos constituted as object of the credits and repo operations celebrated by said Institution with the Bank of Mexico, respectively, have had since the moment of their constitution, in the guarantee fund.”

“Constitution of Special Guarantees Article 195 Bis 5.- On each Banking Business Day, the Bank of Mexico will inform each of the Institutions, through the SAGAPL or any other electronic, computing or telecommunications medium authorized for such effect by the Bank of Mexico and made known to the Institutions, the total value of the Special Guarantees that must be constituted, for the guarantee fund to cover the value that has resulted at the charge of the Institution. … I. With respect to: a) BONDES; b) IPAB Values; c) BREMS; d) CETES excluding SPECIAL CETES, and e) Segregated Coupons, Institutions must constitute the Special Guarantee through stock pledge with transfer of ownership in the terms and under the conditions provided in the contract that they have celebrated for such effect in accordance with article 176 of these Provisions. Institutions must deposit the titles object of said Special Guarantee, through a transfer instructed by means of the SAGAPL or through any other electronic computing or telecommunications medium authorized for such effect by the Bank itself, into the Bank of Mexico account that, for such effects, it has opened in some institution for the deposit of values. For the foregoing, Institutions must present to the Operations Management Department, a mandate in favor of the Bank of Mexico in terms of Annex 10 of these Provisions, signed by whoever has the faculties referred to in article 176, of which they must send a copy to the institution for the deposit of values corresponding. Institutions must carry out the deposit of titles, before the time established in the SAGAPL manual on the Banking Business Day on which the Bank of Mexico has made known to them the amount of the respective Special Guarantees. If the SAGAPL is not available, Institutions must send a request to the Bank of Mexico in a format substantially equal to the format attached to these Provisions as Annex 12 Bis 5, no later than 16:00:00 hours of the Banking Business Day on which they intend to constitute the Special Guarantee, in which they indicate the types of values with which they intend to constitute said Special Guarantee, as well as the amount of each of them. TRANSITORY PROVISIONS FIRST.- The modifications to the "Provisions applicable to the operations of credit institutions, multiple-object financial societies regulated that maintain patrimonial links with credit institutions and the National Financial Institution for Agricultural, Rural, Forestry and Fisheries Development" provided for in this Circular will enter into force on January 1, 2025, without prejudice to what is provided in the following transitory articles. SECOND.- From January 1, 2024, Institutions that enter into contracts to formalize new operations must refrain from using as a reference in said contracts the Interbank Equilibrium Interest Rates in national currency for terms of 91 and 182 days. However, Institutions may continue to use, as a reference rate, the Interbank Equilibrium Interest Rates in national currency for terms of 91 and 182 days, as applicable, that the Bank of Mexico publishes in accordance with Chapter IV of Title Third of the "Provisions applicable to the operations of credit institutions, multiple-object financial societies regulated that maintain patrimonial links with credit institutions and the National Financial Institution for Agricultural, Rural, Forestry and Fisheries Development" issued by the Bank of Mexico through Circular 3/2012, published in the Official Gazette of the Federation on March 2, 2012, as it has been modified by subsequent resolutions, only in those operations that they carry out under contracts entered into prior to the date indicated in this article, as well as in stock certificates issued with reason for multianual investment programs formalized prior to the same date. In these cases, Institutions may use the indicated reference rates until the maturity of the referred contracts.
