The Bank of Mexico requires investment companies to submit a certified copy or original of the notarial deed granting administrative powers to the officials signing the communication referenced in Circular 3/2003, along with a simple copy. This submission must be sent to the Bank's Operational Processing Directorate to allow for review and verification. The Bank will return the certified document or original to the respective investment companies after the review is completed.
CIRCULAR 5/2003 Mexico, D.F., July 8, 2003. TO INVESTMENT COMPANIES: SUBJECT: PROVISIONS ISSUED BY THE BANK OF MEXICO DIRECTED AT INVESTMENT COMPANIES.
The Bank of Mexico, pursuant to the provisions of Articles 24, 26, and 36 of its Law, as well as Article 15 of the Investment Companies Law, and resulting from inquiries made by various investment companies regarding the provisions established in Circulars 3/2003 and 4/2003, informs them that to comply with the aforementioned Circulars, they must send to the Operational Processing Directorate of this Central Bank, attached to the communication referred to in Circular 3/2003, the certified copy or the certified copy of the notarial deed containing the powers of administration for the officials who sign such communication, as well as a simple copy.
The foregoing is for the purpose that this Central Bank, once the respective review and verification have been made, returns to those companies the certified copy or original, as applicable.
