Circular 5/2010 — Modifies Circular 2019/95

The Bank of Mexico repeals sections M.36.3, M.36.31, and M.36.32 of Circular 2019/95. The repeal of section M.36.32 takes effect on January 15, 2010, while the repeals of sections M.36.3 and M.36.31 take effect on April 30, 2010. These changes follow the publication of Circular 24/2009 regarding ATM commission disclosures.

CIRCULAR 5/2010 Mexico, D.F., January 14, 2010.

TO MULTIBANK INSTITUTIONS:

SUBJECT: MODIFICATIONS TO CIRCULAR 2019/95.

The Bank of Mexico, based on Articles 28 of the Political Constitution of the United Mexican States, sixth and seventh paragraphs; 24 of the Bank of Mexico Law; 22 of the Law for Transparency and Orderly Regulation of Financial Services; 48 of the Credit Institutions Law; as well as paragraphs 8, third and sixth, 10, 14 in relation to 25, fraction II; 17, fraction I, and 20, fraction IV, which provide the powers of the Bank of Mexico through the General Directorate of Analysis of the Financial System, the Directorate of Central Bank Regulations, and the Directorate of Operational and Payment Systems, to issue regulations, all of them from the Internal Regulations of the Bank of Mexico, Single Agreement on the Assignment of Administrative Units of the Bank of Mexico, fractions I, III, and IV, with the purpose of promoting the sound development of the financial system through the update of the regulation directed at said institutions, considering that on October 12, 2009, Circular 24/2009 was published in the Official Gazette of the Federation, which modifies Circular 17/2009 regarding "General provisions related to the collection of commissions," which provides, among other aspects, the information that automatic teller machine operators must display on screens, in terms of the respective numbers, which will enter into force on a near date; has resolved to repeal sections M.36.3; M.36.31; and M.36.32, all of Circular 2019/95, to remain in the following terms:

“M.36.3. Repealed.”

“M.36.31. Repealed.”

“M.36.32. Repealed.”

TRANSITIONAL PROVISION

SINGLE. This Circular will enter into force with respect to section M.36.32 of Circular 2019/95 on January 15, 2010, and in relation to sections M.36.3 and M.36.31 of the aforementioned Circular, on April 30, 2010.
