Circular 9/2009 — Modification of Circular 2019/95

The Bank of Mexico amends section M.13.22 of Circular 2019/95 to require multiple banking institutions to exclude the U.S. dollar amount assigned from their participation in U.S. Dollar Credit Auctions held under Circular 8/2009 when calculating their total liabilities limit for foreign currency operations. This modification applies to all multiple banking institutions and enters into force on April 17, 2009.

TO MULTIPLE BANKING INSTITUTIONS:

SUBJECT: MODIFICATIONS TO CIRCULAR 2019/95.

The Bank of Mexico, pursuant to Article 28 of the Political Constitution of the United Mexican States, sixth and seventh paragraphs; Articles 7 (sections I, II, and X), 8, 14, 16, 24, and 36 of the Bank of Mexico Law; Article 22 of the Law for Transparency and Regulation of Financial Services; Articles 8 (third and sixth paragraphs), 17 (section I), and 25 (section II) of the Internal Regulations of the Bank of Mexico, which provide for the attribution of the Central Bank, through the Directorate of Central Banking Regulations and the Directorate of Financial System Analysis, respectively, to issue regulations; Article 1 (sections I and III) of the Agreement on the Assignment of Administrative Units of the Bank of Mexico, with the objective of promoting the sound development of the financial system by granting regulatory facilities to these institutions regarding their participation in U.S. Dollar Credit Auctions, has resolved to add a second paragraph to section M.13.22 of Circular 2019/95, so that it reads as follows:

M.13. ADMISSION REGIME FOR LIABILITIES AND INVESTMENT FOR FOREIGN CURRENCY OPERATIONS

M.13.2 LIMIT ON ADMISSION OF LIABILITIES

M.13.22. ...

For the determination of the total amount of liabilities referred to in this section, institutions shall not consider the amount in U.S. Dollars assigned to them as a result of their participation in the U.S. Dollar Credit Auctions held by the Bank of Mexico, under Circular 8/2009 dated April 15, 2009.”

TRANSITORY PROVISION

SINGLE. This modification shall enter into force on April 17, 2009.
