The National Commission for the Retirement Savings System (CONSAR) amends Rule Seventh of Circular CONSAR 19-8 by adding fraction LIII, requiring AFORE administrators to report information on lawsuits in which they are named as defendants regarding individual accounts. This obligation is detailed in the newly added Annex 149, which mandates the submission of aggregated quarterly data including case details, actor information, account holder data, claims, and procedural status. The additions enter into force on the last business day of April 2024, at which point administrators must begin transmitting the specified information.

ADDITIONS TO THE GENERAL RULES TO WHICH THE INFORMATION
THAT ADMINISTRATORS OF RETIREMENT FUNDS, SPECIALIZED INVESTMENT SOCIETIES
FOR RETIREMENT FUNDS, RECEIVING ENTITIES, AND COMPANIES
OPERATING THE NATIONAL SAR DATABASE MUST SUBMIT TO THE NATIONAL COMMISSION
FOR THE RETIREMENT SAVINGS SYSTEM.
The President of the National Commission for the Retirement Savings System, based on the provisions of
articles 5 fractions I, II, VII and XVI, 12 fractions I, VIII and XVI, 88, 89, 90 fractions II, 91 and
113 of the Law of the Retirement Savings Systems;
106 of the Law of the Institute for Security and Social Services for State Workers;
140 of the Regulations of the Law of the Retirement Savings Systems;
1, 2 fraction III and 8 first paragraph of the Internal Regulations of the National Commission for the
Retirement Savings System, and
CONSIDERING
That Circular 19-8, "General Rules to Which the Information That Administrators of Retirement Funds, Specialized Investment Societies for Retirement Funds, Receiving Entities, and Companies Operating the National SAR Database Must Subject the Information They Deliver to the National Commission for the Retirement Savings System" with its modifications and additions, has as its object to establish the procedure and requirements to which Administrators of Retirement Funds, Specialized Investment Societies for Retirement Funds, Receiving Entities, and Companies Operating the National SAR Database must be subject, regarding the information they must provide to the Commission, so that it has the necessary elements to supervise their proper functioning;
That as a result of the number of lawsuits against Administrators, which can be an alert indicator for the Retirement Savings System, it is necessary to have sufficient information on how many and what type of lawsuits are pending.
That in order to have continuous follow-up by the Administrators and the Commission, it is necessary to have information on the judicial and jurisdictional proceedings being pursued against the Administrators.
That, in order to have all the necessary information to supervise the functioning of Participants in the Retirement Savings Systems, it is necessary to add Annex 149 so that this Commission has information on the lawsuits in which Administrators are parties, with information accumulated at the end of the Quarter, with the aim that CONSAR focuses its coordination, regulation
and, if applicable, supervision efforts to contribute to the gradual reduction of judicial proceedings affecting the Retirement Savings System and consequently help alleviate the current saturation of the organs administering justice for the benefit of Workers, has seen fit to issue the following:
That in order to comply with what is established in article 78 of the General Law of Regulatory Improvement, as well as in article Fifth of the "Agreement that establishes the guidelines that must be observed by the dependencies and decentralized organisms of the Federal Public Administration, regarding the issuance of general administrative acts to which article 69-H of the Federal Administrative Procedure Law applies", the eliminations made in article 121, first paragraph; 157, sixth paragraph, and
197 of the Modifications and Additions to the General Provisions in matters of operations of the retirement savings systems published in the Official Journal of the Federation on May 15, 2020, in terms of the corresponding Regulatory Quality Annex, has seen fit to issue the following:

FIRST.-

TRANSITORY

Integer numeric data (quantities or numeric keys). Must be right-justified; if the length

SPECIFIC POLICIES OF THE PROCESS
Policies to be followed in the transmission of information
The information that will be transmitted to the Commission based on this format, will be subject to the following policies:
I.
The transmission of the sending of the information transmission formats by process will be through the private network using Connect:Direct software or any other compatible with it.
II.
Transmissions may be made as many times as necessary to the RECEPCION directory. However, within the 30 minutes prior to the end of the transmission schedule, they may carry out the retransmissions they require to the RETRANSMISION directory, provided that an information send has been previously made to the RECEPCION directory, regardless of whether it has been accepted or rejected. If the transmission of the file is carried out outside the specified transmission schedule and/or on a date not corresponding to its normal send, the file must be transmitted to the RETRANSMISION directory and will be validated with prior authorization from the Commission's Surveillance areas.
III.
In the case of a prejudicial procedure, those entered at the end of the quarter (Jan, Apr, Jul, and Oct) will be reported, regardless of whether they are concluded or not.
IV.
The entities committed to transmitting the information transmission format by process will be the obligated subjects (AFORE).
V.
When it concerns actors who are not clients of the Afores, the fields must be filled with the minimum information contained in the initial complaint and evidence, and in the rest N/A (Not Applicable) must be added.
VI.
For the case of assigned accounts and service provider, only the data available to the Afore and those derived from the initial complaint and evidence must be filled in.
VII.
In the "Catalog of Sense of the Judgment or Award", when the same judgment or award does not condemn or acquit, with respect to the benefits claimed by the plaintiff, "Other" must be indicated.
VIII.
In the event of the elimination of the Jurisdictional Body in which the trial is located and it is sent to another Jurisdictional Body, the name of the first Authority must be recorded, and subsequently separating it by a / the name of the second Authority.
IX.
The Seizure or remittance of resources referred to in the "Catalog of Benefits", a percentage of the Individual Account for non-compliance with alimony or other obligations, is applicable to those procedures in which the seizure or remittance of percentages of the individual account is ordered to guarantee obligations, such as alimony or others.
X.
The Commission will notify, in due course, the corresponding changes and additions to the catalogs.

It should be mentioned that once having the file with this name, it must be encrypted with the GNUpg program, which will rename it with the following name:
20230307_AF_530_000.2018.gpg
With this name is the one with which the file must be transmitted to CONSAR. For the recovery of the acknowledgments, the participating entities must take their "Acknowledgment" with the same name with which they renamed it before encrypting it, they will only have to add the character "A" before the date, example:
A 20230307_AF_530_000.2018
NOTE: The .gpg extension will not be taken into account in the recovery of the acknowledgment, as shown in the example, nor will the acknowledgment be encrypted.
