Banks Non-Bank Payment Card Issuing Companies
This Commission, exercising its legal powers, especially those set forth in item 1 of Article 5 and item 3 of Article 20 of Decree Law No. 3,538, of 1980; and as agreed by the Commission Council in Ordinary Session No. 509, of August 13, 2026, has deemed it necessary to issue the following instructions:
I. Adjustments are introduced to Chapter 2-13 of the Updated Compilation of Regulations in the following terms:
In item No. 1, the expression “in fiscal vaults” is replaced by “to the National Firefighters Corps of Chile.”
The first paragraph of title No. 3 is replaced by the following:
Banks shall prepare, in the month of January of each year, a list of claims subject to expiration that have been immobilized for two years during the immediately preceding calendar year. They must post this list at their main office. Likewise, they must send to this Commission the E30 file “Bank Claims Subject to Expiration” of the Information System Manual for banks by no later than the tenth banking business day of the month of February of each year.
The title of item No. 6 is replaced by “Transfer of these values to the National Firefighters Corps of Chile.”
In the sole paragraph of item No. 6, the expression “in the corresponding Municipal Treasury of their main office” is replaced by “to the National Firefighters Corps of Chile.”
II. Adjustments are introduced to Circular No. 1 of Non-Bank Payment Card Issuing Companies in the following terms:
The title of item 4.3 of Title IV is replaced by “Transfer of these values to the Chilean State and to the National Firefighters Corps of Chile.”
The sole paragraph of item 4.3 of Title IV is replaced by the following:
Once the deadlines indicated in the preceding items have been met, Issuers must pay the amount of expired claims arising from payment instruments issued nominatively to the National Firefighters Corps of Chile. Similarly, they must pay the amount of expired claims arising from bearer payment instruments to the Regional or Provincial Treasury corresponding to their main office.
