Financial entities and authorized systemically important financial market infrastructures must update the consolidated text of the National Payments System regulations regarding checks and other negotiable instruments. The update mandates that the Certification for Civil Actions (CAC) for rejected electronic checks (ECHEQ) be issued on paper, signed by two authorized officials, and include a visualization code for centralized verification via the Low-Value Clearing House. Depository financial entities are exclusively responsible for issuing this certification upon beneficiary request, which blocks the ECHEQ registration in the storage system. These provisions replace previous sheets and are effective from July 24, 2026.

3.4.3.2. Management: may be carried out by financial entities as well as by systemically important financial market infrastructures, authorized for such purposes by the BCRA. Regarding the custody/registration of checks generated by electronic means (ECHEQ) for stock market negotiation, such infrastructures must additionally have the approval of the relevant supervisory body. In the case of the negotiation of an ECHEQ or another negotiable electronic document, the ECHEQ managing entities must send the required information to the storage system, with their exclusive responsibility being the integrity and validity of the data provided regarding the last legitimate holder and/or, where applicable, existing guarantees. 3.4.3.3. Deposit: shall be an exclusive and mandatory function of financial entities. 3.4.3.4. Financial entities and other participants must make available to their customers the functionalities included in the role or service of issuance, management, or deposit as appropriate, and may not carry out partial implementations for the same service. 3.4.4. Certification for Civil Actions (CAC) If for any reason an ECHEQ is not paid, in whole or in part, the depository financial entity or the financial entity where the payer client (member of the endorsement chain, guarantor, or assignee) of a rejected ECHEQ holds an account – provided they are legitimized for these purposes – must issue, upon the beneficiary's request, the Certification for Civil Actions (CAC) established in Article 61 of the Checks Law. In the case of counter collection, the drawn bank will be responsible for this function. The issuance of this certification will block the registration of the ECHEQ in the Storage System for electronically generated checks. Its issuance will be on paper support, without special security measures, and must be signed by two authorized officials of the financial entity at the bottom of the document, with all its pages initialized. In order for judicial officials, endorsers, guarantors, or third parties who have accessed the document to be able to consult the concordance of what is stated in the CAC with the data in the check storage system, each CAC will have a "Visualization Code" to verify the information through an internet page. This internet page for the centralized consultation of the CAC through its visualization code will be implemented by the Low-Value Clearing House (CEC-BV) which has the mandate to operate and administer the storage system for ECHEQs.
