CMN Resolution 5,338 — Amends CMN Resolution 5,130, of April 25, 2024, on financing under the External Private Capital Mobilization and Exchange Protection Line (Eco Invest Brasil) within the National Fund on Climate Change (FNMC)

Amends CMN Resolution No. 5,130, of April 25, 2024, regarding financing under the Eco Invest Brasil Line within the National Fund on Climate Change. Financial institutions must present a schedule for effective mobilization of external capital at the auction act, observing a maximum period of twenty-four months from the date of receipt of the first disbursement. The remuneration of the financial institution for making resources available to the Eco Invest Brasil Innovation Funds is limited to 3% per year, while the maximum remuneration earned in operations with these resources is capped at 4% per year. The resolution takes effect on the date of its publication.

The Central Bank of Brazil, pursuant to art. 9 of Law No. 4,595, of December 31, 1964, makes public that the National Monetary Council, in an extraordinary session held on August 27, 2026, based on the provisions of arts. 33, § 1, 34 and 40, all of Law No. 14,995, of October 10, 2024,

R E S O L V E D :

Art. 1 CMN Resolution No. 5,130, of April 25, 2024, published in the Official Gazette of the Union on April 26, 2024, shall take effect with the following amendments:

"Art. 3 ..............................................................

I - at the auction act referred to in art. 2, § 1, financial institutions shall present a schedule for the effective mobilization of external capital to the project, observing the maximum period of twenty-four months from the date of receipt of the first disbursement;

III - the remuneration of the financial institution for the availability of resources from the Eco Invest Brasil Line to the Eco Invest Brasil Innovation Funds shall be limited to 3% p.a. (three percent per year);

V - the maximum remuneration earned by the financial institution in operations carried out with resources from the Eco Invest Brasil Line destined to the Eco Invest Brasil Innovation Funds shall correspond to the conversion into factors of the charges provided for in items III and IV, limited to 4% p.a. (four percent per year);

Art. 2 This Resolution shall take effect on the date of its publication.
