CMN Resolution No. 5336 — Amends CMN Resolution No. 5,292, of April 16, 2026, Establishing Conditions, Financial Charges, Terms and Regulatory Norms for Financing Lines Under Law No. 15,473, of July 22, 2026

Amends CMN Resolution No. 5,292 of April 16, 2026, to update regulatory norms for financing lines under Law No. 15,473 of July 22, 2026. Eligibility extends to legal entities listed in Interministerial Ordinance MDIC/MF No. 171 of April 13, 2026, including those in fertilizer and critical mineral activities (CNAE 20.13-4, 20.12-6, 08.91-6). Financial terms set a 3% per annum remuneration rate for specific strategic activities, require 50% or 100% funding from law-defined sources, allocate risk to BNDES or enabled institutions, and apply to requests filed until December 31, 2027.

The Central Bank of Brazil, pursuant to Article 9 of Law No. 4,595, of December 31, 1964, makes public that the National Monetary Council, in an extraordinary session held on August 27, 2026, in view of the provisions of Article 4, heading, item VI, of Law No. 4,595, of December 31, 1964, and of Article 3, Section 5, of Law No. 15,473, of July 22, 2026,

R E S O L V E D :

Article 1 The title of CMN Resolution No. 5,292, of April 16, 2026, published in the Official Gazette of the Union of April 17, 2026, shall enter into force with the following amendments:

"Establishes the conditions, financial charges, terms and other regulatory norms for the financing lines referred to in Law No. 15,473, of July 22, 2026." (New Wording)

Article 2 CMN Resolution No. 5,292, of April 16, 2026, published in the Official Gazette of the Union of April 17, 2026, shall enter into force with the following amendments:

"Article 1 The financing lines with the purpose of supporting the legal entities authorized by Law No. 15,473, of July 22, 2026, using resource sources defined in Article 3 of said Law, shall be granted by the National Bank for Economic and Social Development – BNDES or by financial institutions enabled by it, which shall assume the risks of the operations, including credit risk, consisting of financing to:

Sole Paragraph. The financial conditions established in this Resolution apply even when the resources referred to in Article 3 of Law No. 15,473, of July 22, 2026, for the availability of the financing lines referred to in this Resolution are combined with BNDES resources for the granting of said financing lines, observing the provisions of Article 3, heading, item IV." "Article 2 According to a joint act of the Minister of State for Development, Industry, Commerce and Services and the Minister of State of Finance regarding the eligibility criteria for the recipients of support measures provided for in Law No. 15,473, of July 22, 2026, shall have access to the financing lines referred to in Article 1 of this Resolution the legal entities listed in Article 2, heading, items I to III, of Interministerial Ordinance MDIC/MF No. 171, of April 13, 2026.

Section 3 The legal entities referred to in Article 2, heading, item II, of Interministerial Ordinance MDIC/MF No. 171, of April 13, 2026, may access financing intended for the purposes referred to in Article 1, heading, items I to V, of this Resolution, if they operate in the manufacturing of fertilizers and soil conditioners, in the manufacturing of intermediates for fertilizers or in the extraction of minerals for manufacturing fertilizers, soil conditioners and other chemical products, according to respective codes of the National Classification of Economic Activities – CNAE 20.13-4, 20.12-6 and 08.91-6, contained in Annex I of said Ordinance." a) as remuneration of the resource source referred to in Article 3 of Law No. 15,473, of July 22, 2026:

  1. for the purposes referred to in Article 1, heading, items IV and V: 3% p.a. (three percent per annum), if the borrower referred to in Article 2, heading, item II, of Interministerial Ordinance MDIC/MF No. 171, of April 13, 2026, is active in industrial and technological activities in the chain of critical and strategic minerals, according to CNAE codes contained in Annex I of said Ordinance;

  1. 50% (fifty percent) derived from the resources referred to in Article 3 of Law No. 15,473, of July 22, 2026; and

b) for the purpose referred to in Article 1, heading, items IV and V: 100% (one hundred percent) derived from the resources referred to in Article 3 of Law No. 15,473, of July 22, 2026; and

V - operation risk: of BNDES, when operating directly, or of the financial institution enabled by it in indirect operations, remaining BNDES, in both cases, responsible, before the resource source referred to in Article 3 of Law No. 15,473, of July 22, 2026, for the payment of principal and remuneration referred to in item II, subitem "a".

Article 3 This Resolution enters into force on the date of its publication.
