COBAC Instruction I-2009/02 on the Prior Information Procedure for Appointing Board Members of Credit Institutions

The COBAC Instruction I-2009/02 establishes the prior information procedure for the designation of board members in credit institutions within the CEMAC region. It requires that the prior information submitted to the COBAC be accompanied by a criminal record extract or equivalent document issued within the last three months, a signed curriculum vitae following a specific model, and a signed declaration of honor. The instruction entered into force on the date of its signature, September 25, 2009.

CENTRAL AFRICAN BANKING COMMISSION

INSTRUCTION COBAC I-2009/02 ON THE PRIOR INFORMATION PROCEDURE FOR THE APPOINTMENT AS A MEMBER OF THE BOARD OF DIRECTORS OF A CREDIT INSTITUTION

The President of the Central African Banking Commission;

Having regard to Regulation No. 0408/CEMAC/UMAC/COBAC on corporate governance in credit institutions of the Economic and Monetary Community of Central Africa, particularly Articles 11 and 12;

Having regard to COBAC Decision D-2009/105 delegating powers to the President of the Central African Banking Commission in the prior information procedure for the appointment as a member of the Board of Directors of a credit institution;

DECIDES:

Article 1: The prior information to the Central African Banking Commission for the appointment as a member of the Board of Directors of a credit institution shall be accompanied by the following documents and information:

  • a criminal record extract or any other document serving as a substitute, dated less than three months old, issued by the competent national authorities of the country of the person concerned;
  • a curriculum vitae signed by the person concerned to attest in particular to their training and professional experience, according to the model attached as an annex;
  • a sworn declaration signed by the person concerned, according to the model attached as an annex;

Article 2: This Instruction shall enter into force as of the date of its signature.
