The European Commission,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive (EU) 2016/97 of the European Parliament and of the Council of 20 January 2016 on insurance distribution and amending Directives 2002/92/EC and 2013/36/EU, and in particular Article 20(9) thereof,
Whereas:
(1) Directive (EU) 2016/97 requires that an insurance product information document be provided to the client before the conclusion of the insurance contract. That document should enable the client to compare different insurance products.
(2) To ensure that the insurance product information document is clear, concise and comparable, it is necessary to lay down a standardised presentation format.
(3) That format should specify the content, structure, design, font size and order of the information to be provided.
(4) The information should be presented in a clear and understandable language, focusing on the essential information needed by the client to make an informed decision.
(5) The use of icons should help the client to identify the different sections of the document quickly.
(6) The measures provided for in this Regulation are in accordance with the opinion of the European Insurance and Occupational Pensions Authority,
HAS ADOPTED THIS REGULATION:
Immediately below the heading 'Insurance Product Information Document', at the top of the first page, the name of the non-life insurance product creator, the Member State in which it is registered, its legal status and, where applicable, the number of the authorisation to operate shall be provided.
The product creator may add the company logo to the right of the heading.
The Insurance Product Information Document shall clearly indicate that full pre-contractual and contractual information on the non-life insurance product is provided to the client in other documents. That indication shall be provided immediately below the name of the non-life insurance product creator.
The length of the Insurance Product Information Document shall be two A4 pages when printed. If, exceptionally, more space is needed, the Insurance Product Information Document may be up to three A4 pages when printed. Where the product creator's information document is three A4 pages, it shall, upon request by the competent authority, be able to demonstrate that more space was needed to present the information.
The information provided in the Insurance Product Information Document, which is listed in Article 20(8) of Directive (EU) 2016/97, shall be presented point by point, following the structure, design, points and order of the standard format set out in the Annex to this Regulation, using a character size with an x-height of at least 1,2 mm.
The length of the points shall depend on the information provided under each point. There shall be no check mark, cross or exclamation mark before the information on additional products or optional insurance cover.
Where the Insurance Product Information Document is provided on a medium other than paper, the size of the design elements may be changed, provided that the design of the standard format, the headings and the order of the information remain the same, as well as the relative importance and volume of the different elements.
Where the dimensions of a medium other than paper are such that it is not reasonable to present the information in two columns, it may be presented in one column, provided that the points are ordered as follows:
a) 'What type of insurance is it?' b) 'What is covered?' c) 'What is not covered?' d) 'Are there any limitations on the cover?' e) 'Where am I covered?' f) 'What are my obligations?' g) 'When and how do I pay?' h) 'When does the cover start and end?' i) 'How can I terminate the contract?'
The use of digital means, including layers and pop-up windows, is permitted, provided that all information referred to in Article 20(8) of Directive (EU) 2016/97 is presented in the main part of the Insurance Product Information Document and that the use of such means does not distract the client's attention from the content of the main document.
Information provided through layers and pop-up menus shall not contain marketing or advertising material.
The Insurance Product Information Document shall be drawn up in clear language that facilitates the client's understanding of the content of the document, and shall focus on the essential information that the client needs to make an informed decision. Jargon shall be avoided.
The information in the Insurance Product Information Document shall be presented under the following points:
a) information on the type of insurance referred to in Article 20(8)(a) of Directive (EU) 2016/97 shall be presented at the beginning of the document under the point 'What type of insurance is it?'; b) information on the main risks covered referred to in Article 20(8)(b) of Directive (EU) 2016/97 shall be presented under the point 'What is covered?'. Under this point, there shall be a green check mark before each list item; c) information on the sum insured referred to in Article 20(8)(b) of Directive (EU) 2016/97 shall be presented under the point 'What is covered?'; d) information on the geographical scope referred to in Article 20(8)(b) of Directive (EU) 2016/97 shall be presented, where necessary, under the point 'Where am I covered?'. Under this point, there shall be a blue check mark before each list item; e) information on a summary of the risks not covered referred to in Article 20(8)(b) of Directive (EU) 2016/97 shall be presented under the point 'What is not covered?'. Under this point, there shall be a red cross before each list item; f) information on the most important cases not covered referred to in Article 20(8)(d) of Directive (EU) 2016/97 shall be presented under the point 'Are there any limitations on the cover?'. Under this point, there shall be an orange exclamation mark before each list item; g) information on the relevant obligations referred to in Article 20(8)(e), (f) and (g) of Directive (EU) 2016/97 shall be presented under the point 'What are my obligations?'; h) information on the method and duration of payment of insurance premiums referred to in Article 20(8)(c) of Directive (EU) 2016/97 shall be presented under the point 'When and how do I pay?'; i) information on the duration of the contract referred to in Article 20(8)(h) of Directive (EU) 2016/97 shall be presented under the point 'When does the cover start and end?'; j) information on the method of termination of the contract referred to in Article 20(8)(i) of Directive (EU) 2016/97 shall be presented under the point 'How can I terminate the contract?'.
Sub-points may be used where necessary.
In addition, the points shall be marked with the following icons, which visually reflect the content of each point:
a) a umbrella icon, which is white on a green background or green on a white background, before the information on the main risks covered referred to in Article 20(8)(b) of Directive (EU) 2016/97; b) a globe icon, which is white on a blue background or blue on a white background, before the information on the geographical scope referred to in Article 20(8)(b) of Directive (EU) 2016/97; c) a triangle with a cross icon, which is white on a red background or red on a white background, before the information on a summary of the risks not covered referred to in Article 20(8)(b) of Directive (EU) 2016/97; d) a triangle with an exclamation mark ('!') icon, which is white on an orange background or orange on a white background, before the information on the most important cases not covered referred to in Article 20(8)(d) of Directive (EU) 2016/97; e) a handshake icon, which is white on a green background or green on a white background, before the information on the obligations referred to in Article 20(8)(e), (f) and (g) of Directive (EU) 2016/97 (obligations before the conclusion of the contract, during the period of validity and arising from the submission of a claim); f) a coin icon, which is white on a yellow background or yellow on a white background, before the information on the method and duration of payment of insurance premiums referred to in Article 20(8)(c) of Directive (EU) 2016/97; g) a hourglass icon, which is white on a blue background or blue on a white background, before the information on the duration of the contract referred to in Article 20(8)(h) of Directive (EU) 2016/97; h) an icon depicting an open palm hand on a shield, which is white on a black background or black on a white background, before the information on the method of termination of the contract referred to in Article 20(8)(i) of Directive (EU) 2016/97.
All icons shall be consistent with the standard format set out in the Annex.
The icons referred to in paragraphs 1 and 2 may be black and white where the Insurance Product Information Document is printed or copied in black and white.
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
