Commission Implementing Regulation (EU) 2021/955 on technical standards for cross-border marketing of AIFs and UCITS
The European Commission adopted Implementing Regulation (EU) 2021/955 to establish standardized templates, forms, and procedures for the publication of national marketing rules and fees by competent authorities, as well as for notifications to ESMA. Competent authorities are required to publish information on marketing requirements and fees using specific templates defined in Annexes I, II, and III, and to notify ESMA of website hyperlinks using the forms in Annexes IV and V. Additionally, home Member State competent authorities must transmit quarterly data to ESMA via a central database and notification portal using XML formats specified in Annex VI. These obligations apply from 2 August 2021 for publication and notification templates, and from 2 February 2022 for the central database data transmission.
