Commission Implementing Regulation (EU) 2022/694 amending Regulation (EU) 2016/403 on serious infringements affecting road transport operator good repute

The European Commission amends Regulation (EU) 2016/403 by replacing Annex I to update the classification of serious infringements that may lead to the loss of good repute by road transport operators. The revised Annex I introduces new categories for infringements related to the law applicable to contractual obligations (Rome I) and the posting of workers, while replacing existing sections on driving and resting times, tachograph use, speed limitation devices, and access to haulage and passenger transport markets. Annex II is replaced to mandate that Member States calculate the frequency of repeated serious or very serious infringements based on the number of vehicles used, rather than the number of drivers. This Regulation enters into force on the twentieth day following its publication in the Official Journal of the European Union.
