The Central Bank of Uruguay amends the Compilation of Payment System Rules by adding Article 171.1 to Book IV, requiring Payment and Collection Service Providers to implement adequate prevention mechanisms to stop transactions associated with illegal gambling and betting. This obligation extends the existing regulatory framework for Electronic Money Issuers to these service providers to ensure a solid, efficient, and secure payment system. The resolution was adopted on July 3, 2024, and communicated via Circular No. 2459.

BOARD OF DIRECTORS - RESOLUTION Montevideo, July 3, 2024. BOARD OF DIRECTORS VIEWING: money transactions associated with illegal gambling and betting of any nature. RESULTING: that from the legal framework regarding gambling and online betting, the illegality arises in the provision of services of that nature through the internet, technological platforms, computer applications, or similar when the activity is not authorized by the competent authority. CONSIDERING: I) that, with the aim of favoring a solid, efficient, innovative, accessible, and secure payment system, rules must be issued in accordance with market development; II) that in this sense, it is convenient to extend to Payment and Collection Service Providers the scope of the existing regulatory framework for Electronic Money Issuers so that they have the obligation to adopt measures to prevent such non-compliance through their services. ATTENTION: to the above, to the provisions of Law No. 1,595 of December 12, 1882, Law No. 16,696 of March 30, 1995, Law No. 18,573 of September 13, 2009, Law No. 19,210 of April 29, 2014 and their respective amendments, to Article 244 of Law No. 19,535 of September 25, 2017, to Decree No. 366/017 of December 21, 2017, to what was reported by the Payment Systems Management on July 2, 2024, and other background information appearing in file No. 2024-50-1-1175, IT IS RESOLVED:
"Article 171.1 (PROHIBITIONS). Payment and Collection Service Providers must have adequate prevention mechanisms to avoid that through their intermediation, money transactions associated with illegal gambling and betting of any nature are channeled.
