DIRECTORATE - RESOLUTION Montevideo, April 11, 2024. D I R E C T O R I A T E HAVING SEEN: the incorporation into the national market of fully touch electronic payment processing terminals (POS). RESULTING FROM: I) that the Central Bank of Uruguay has received complaints referring to the difficulties faced by people with visual disabilities when using their electronic payment methods on electronic point-of-sale terminals; II) that some of the new touch POS terminals acquired by POS Administrator companies do not allow their use by people with visual disabilities, as they lack an analog keyboard, as conventional terminals do; III) that the Norms and Surveillance Department of the Payment System Management has conducted an analysis of the Compilation of Payment System Rules and considers it appropriate to modify the current regulations, taking into account the needs of market users; IV) that on March 5, 2024, the interested groups were notified of the respective draft resolution, and they did not present any objections. CONSIDERING: I) that Article 366 of the Compilation of Rules and Controls of the Financial System establishes – among other things – the obligation of the user not to disclose the personal identification code (password or PIN) or any other code, taking adequate measures to guarantee its security, as well as not entering the personal identification code in the presence of other people, even if they intend to help, nor lending the electronic instrument to third parties, as it is for personal use; II) that Article 81.3 of the Compilation of Rules and Controls of the Financial System establishes – among other things – that issuers are liable to users for ensuring that the quality of service throughout the payment transaction cycle meets the minimums established by regulation, ensuring service quality through compliance with quality indicators applicable to service levels, information security, computer security, capacity and operational continuity, as well as service availability, within the framework of current regulations and security policies established by the seals;

DIRECTORATE - RESOLUTION III) that, with the aim of favoring a solid, efficient, innovative, and accessible payment system, symmetric, transparent, and updated regulatory norms must be issued, in accordance with the principle of reasonableness and taking into account the risk each type of entity generates to the National Payment System; IV) that it is important to guarantee the universalization of the use of POS terminals to all users of electronic instruments, including those with visual disabilities. ATTENTIVE: to the above, to the provisions of Law No. 16.696 of March 30, 1995, as amended by Law No. 18.401 of October 24, 2008, to Laws No. 18.573 of September 30, 2009, No. 18.418 of January 20, 2008, and No. 18.651 of February 19, 2010, to the Compilation of Rules and Controls of the Financial System, to Article 84 of the Administrative Regulations of the Central Bank of Uruguay, to the opinion of the Legal Advisory No. 2023/0486 of December 14, 2023, to what was reported by the Payment System Management on April 8, 2024, and other background information appearing in file No. 2023-50-1-2337, IT IS RESOLVED:
“Article 81.2.1 (ACCESS TO POS FOR USERS WITH VISUAL DIFFICULTIES). POS terminal administrators must offer devices whose technology allows access for users with visual disabilities, so as to be able to use these terminals without violating their rights and obligations inherent to the electronic payment medium used. TRANSITIONAL PROVISION: The Payment System Management will require POS Administrator companies to submit an adaptation plan to this regulation, in which they must inform the measures they will implement to comply with it during the year 2024.”
