Compilation of Payment System Rules - Modification of Article 42.3 of Book III

The Central Bank of Uruguay amends Article 42.3 of the Compilation of Payment System Rules to authorize the Payment System Management Department to set a maximum cap on the additional monthly commission charged for rejected documents in the electronic document clearing system. This modification replaces the previous provision, which lacked a ceiling, with a rule allowing the department to establish and communicate this limit to financial institutions.

BOARD OF DIRECTORS - RESOLUTION Montevideo, May 15, 2024. B O A R D O F D I R E C T O R S HAVING VIEWED: Article 42.3 of Part One of Title II of Book III of the Compilation of Payment System Rules. WHEREAS: The article referred to in the HAVING VIEWED section provides for the payment of an additional monthly commission for services provided by the Central Bank of Uruguay to institutions authorized to participate in the electronic document clearing system when documents are rejected during the month, regardless of the cause of rejection, without providing for a cap. CONSIDERING: That it is considered appropriate to grant the Payment System Management Department the authority to set a maximum cap on the additional monthly commission, thereby providing financial institutions with a transparent method to address possible exceptional events. IN ACCORDANCE WITH: The above, as well as the provisions of Law No. 16.696 of March 30, 1995, as amended by Law No. 18.401 of October 24, 2008, Law No. 18.573 of September 30, 2009, Article 42.3 of Book III of the Compilation of Payment System Rules, information provided by the Payment System Management Department on May 13, 2024, and other background materials appearing in file No. 2024-50-1-0354, IT IS RESOLVED:

  1. Incorporate a final subsection into Article 42.3 of Part One of Title II of Book III of the Compilation of Payment System Rules, with the following wording: "The Payment System Management Department may set a maximum cap on the amount of the transaction commission established in this article, communicating it."
  2. Entrust the communication of the provisions herein, by means of Circular, to the Payment System Management Department.
