Compilation of Payment System Rules, substitution of article – Book VII, with transitional provision

The Central Bank of Uruguay substitutes Article 81.2.1 of Book VII of the Compilation of Payment System Rules to require POS terminal administrators to offer technological solutions enabling access for visually impaired users. The regulation extends the compliance deadline until June 30, 2025, during which administrators must submit and obtain approval for an adaptation plan from the Payment System Management. This amendment replaces the previous April 2024 requirement that mandated compliance within 2024.

BOARD OF DIRECTORS - RESOLUTION Montevideo, October 16, 2024. B O A R D O F D I R E C T O R S HAVING SEEN: the incorporation of article 81.2.1 into the Compilation of Rules of the Payment System provided for by resolution D/100/2024 of April 11, 2024. WHEREAS: I) that the aforementioned norm imposes on POS terminal administrators the obligation to offer devices whose technology allows access to persons users with visual disability, in order to be able to use said terminals without violating their rights and obligations inherent to the electronic payment medium used; II) that it also contains a transitional provision by which the Payment System Management will require POS administrators to submit an adaptation plan to the norm to comply with it during the year 2024. CONSIDERING: I) that the referenced norm was issued in the exercise of the legitimate powers granted to the Central Bank of Uruguay by articles 19 and 21 of Law No. 18.573 of September 30, 2009 and with the objectives provided for in article 20 of said law, to provide greater security, efficiency and reliability to the National Payment System, respecting the rights of clients and the principle of non-discrimination; II) that for merit reasons it is considered appropriate to extend the deadline for the entry into force of the norm to facilitate its compliance and the submission of adaptation plans by the entities involved, maintaining legal certainty on the established deadlines and formulating the obligation in terms that promote the incorporation of innovative technological solutions, provided they meet the established purposes. ATTENTIVE: to the above, to what is provided for in article 3 letter B) of Law No. 16.696 of March 30, 1995, in the wording given by article 1 of Law No. 18.401 of October 24 2008, to Law No. 18.651 of February 19, 2010, to articles 19 to 21 of Law No. 18.573 of September 13, 2009, to articles 364 to 367 of Book IV of the Compilation of Rules of Regulation and Control of the Financial System, to articles 81.3 and 81.4 of Book VII of the Compilation of Rules of the Payment System, to the opinions of Legal Advisory No. 2024/0224 of July 4, 2024 and No. 2024/0313 of September 16, 2024, to what was reported by the Legal Advisory and Payment System Management on October 14, 2024 and other background that appear in files No. 2023-50-1-2337 and No. 2024-50-1-0841, R.No.: D-303-2024 CIRCULAR NO. 2465

BOARD OF DIRECTORS - RESOLUTION IT IS RESOLVED:

  1. Substitute article 81.2.1 of the first part of Book VII of the Compilation of Rules of the Payment System with the following text: "Article 81.2.1 (ACCESS TO POS FOR PERSONS USERS WITH VISUAL DIFFICULTIES). POS terminal administrators must offer technological solutions that allow access to persons users with visual disability, in order to be able to use said terminals without violating their rights and obligations inherent to the electronic payment medium used. TRANSITIONAL PROVISION: the application of this norm is suspended until June 30, 2025. Within that deadline, POS terminal administrators must submit an adaptation plan to the present norm to the Payment System Management and obtain its approval by said Management."
  2. Entrust the communication of what is provided, by means of Circular, to the Management of the Payment System.
