The Oregon Insurance Division issued this bulletin to clarify the implementation of House Bill 2116, which mandates that health insurers pay a one percent assessment on gross premiums earned from policies insuring Oregon residents or delivered in Oregon. This requirement applies to all calendar quarters beginning October 1, 2009, with the first payment due by February 15, 2010. Although pending legislation may retroactively remove the requirement for premiums from policies covering Oregon residents, the Division must currently enforce the law as written until such changes are enacted.
