Decision No. 60/1 Approving the Regulation on the Insurance Product Information Document

The National Commission for Financial Market of Moldova issued Decision No. 60/1 to transpose EU Regulation 2017/1469 by approving standardized rules for the Insurance Product Information Document (IPID). On the approval of the Regulation on the Insurance Product Information Document

Pursuant to Article 891 paragraph (2) of Law No. 92/2022 on insurance or reinsurance activity (published in the Official Monitor, 2022, no. 129-133, art. 229), the National Commission of the Financial Market DECIDES:

This Decision transposes Commission Implementing Regulation (EU) 2017/1469 of 11 August 2017 laying down a standard format for the presentation of the insurance product information document, CELEX: 32017R1469, published in the Official Journal of the European Union L 209 of 12 August 2017.

  1. The Regulation on the Insurance Product Information Document is approved (attached).
  2. Until the entry into force of this Decision, insurance companies and insurance intermediaries shall take the necessary measures to align their activities with the provisions of Article 891 paragraph (1) and paragraph (2) of Law No. 92/2022 on insurance or reinsurance activity.
  3. The National Commission of the Financial Market shall develop, as a recommendation, the Insurance Product Information Document for compulsory third-party liability car insurance contracts, domestic and foreign, within two months from the date of publication of this Decision.
  4. This Decision enters into force on 25.06.2026 and is repealed on the date of accession of the Republic of Moldova to the European Union.

2 Approved by Decision of the National Commission of the Financial Market no. 60/1 of 16.12.2025 REGULATION on the Insurance Product Information Document Chapter I GENERAL PROVISIONS

  1. The Regulation on the Insurance Product Information Document (hereinafter – Regulation) establishes the requirements applicable to insurance companies and insurance intermediaries regarding the form and content of the Insurance Product Information Document, the manner of providing it and the conditions for informing the consumer.

  2. The Insurance Product Information Document is made available to the consumer together with other mandatory information according to law, but it shall always constitute a standalone document.

  3. For the purposes of the Regulation, the product developer is the insurance company. Chapter II FORM AND CONTENT OF THE INSURANCE PRODUCT INFORMATION DOCUMENT Section 1 Name and logo of the product developer

  4. Immediately after the title "Insurance Product Information Document", in the upper part of the first page, the name of the product developer described in the document, its legal form of organization, and the license number under which it operates shall be indicated.

  5. The product developer has the right to additionally apply the logo to the right of the title.

  6. The Insurance Product Information Document contains a clear statement that complete pre-contractual and contractual information regarding the general insurance product is provided to the consumer in other documents. This statement shall be added immediately below the name of the insurance product developer. Section 2 Text length

  7. In the printed version, the Insurance Product Information Document is presented on two A4 format pages. If more space is needed, the Insurance Product Information Document may, exceptionally, be presented on three A4 format pages.

3 8. If three A4 format pages are used, the product developer must be able to justify, upon request by the National Commission of the Financial Market, why more space was needed. Section 3 Presentation method and order of sections

  1. The information in the Insurance Product Information Document, provided for in Article 891 paragraph (5) of Law No. 92/2022 on insurance or reinsurance activity (hereinafter – Law No. 92/2022), is presented in separate sections, in accordance with the structure, appearance, titles, and order provided in the standardized format, according to the annex. The font used on the page has a lowercase letter (x) height of at least 1.2 mm.

  2. The length of the sections may vary depending on the volume of information that is to be included in each section. Information regarding any additional insurances and optional coverages must not be preceded by checkmarks, X-shaped signs, exclamation marks, or other similar symbols.

  3. In the case where the Insurance Product Information Document is presented on a durable medium other than paper, the size of the components placed on the page may be modified, provided that the structure of the page, section titles, and order in the standard format, as well as prominence and size associated with different elements are preserved.

  4. When the dimensions of the durable medium, other than paper, do not allow arranging on the page in two columns, a single-column presentation mode may be used, only if the following order of sections is respected: 12.1. "What type of insurance is this?"; 12.2. "What is covered?"; 12.3. "What is not covered?"; 12.4. "Are there coverage restrictions?"; 12.5. "Where am I covered?"; 12.6. "What are my obligations?"; 12.7. "When and how do I pay?"; 12.8. "When does coverage start and end?"; 12.9. "How can I terminate the contract?".

  5. The use of digital tools, such as overlays and pop-up windows, is permitted, provided that all information provided for in Article 891 paragraph (5) of Law No. 92/2022, is provided in the main body of the Insurance Product Information Document and that the use of such tools does not distract the consumer's attention from the content of the main document.

  6. Information provided in overlays and pop-up windows must not contain marketing or advertising materials. Section 4 Use of simple language

  7. The Insurance Product Information Document is drafted in simple language, so as to facilitate the consumer's understanding of the

4 content of the document and focuses on essential information, which the consumer needs to make an informed decision. 16. When drafting the Insurance Product Information Document, jargon must be avoided. Section 5 Section titles and related information

  1. The sections of the Insurance Product Information Document have the following titles and contain the following categories of information: 17.1. information regarding the type of insurance, provided for in Article 891 paragraph (5) letter a) of Law No. 92/2022, is presented under the title "What type of insurance is this?", at the top of the document; 17.2. information regarding the main risks covered, provided for in Article 891 paragraph (5) letter b) of Law No. 92/2022, is presented under the title "What is covered?". In front of each piece of information in this section, a green checkmark is placed; 17.3. information regarding the sum insured, provided for in Article 891 paragraph (5) letter b) of Law No. 92/2022, is presented under the title "What is covered?"; 17.4. information regarding possible geographical coverage, provided for in Article 891 paragraph (5) letter b) of Law No. 92/2022, is presented under the title "Where am I covered?". In front of each piece of information in this section, a blue checkmark is placed; 17.5. information regarding the summary of excluded risks, provided for in Article 891 paragraph (5) letter b) of Law No. 92/2022, is presented under the title "What is not covered?". In front of each piece of information in this section, red X-shaped signs are placed; 17.6. information regarding the main exclusions, provided for in Article 891 paragraph (5) letter d) of Law No. 92/2022, is presented under the title "Are there coverage restrictions?". In front of each piece of information in this section, an orange exclamation mark is placed; 17.7. information regarding relevant obligations, provided for in Article 891 paragraph (5) letters e) – g) of Law No. 92/2022, is presented under the title "What are my obligations?"; 17.8. information regarding methods of paying insurance premiums and the frequency of payments, provided for in Article 891 paragraph (5) letter c) of Law No. 92/2022, is presented under the title "When and how do I pay?"; 17.9. information regarding the duration of the contract, provided for in Article 891 paragraph (5) letter h) of Law No. 92/2022, is presented under the title "When does coverage start and end?"; 17.10. information regarding the methods of terminating the contract, provided for in Article 891 paragraph (5) letter i) of Law No. 92/2022, is presented under the title "How can I terminate the contract?".

  2. When drafting the Insurance Product Information Document, the use of sub-sections is permitted, if necessary, to detail or supplement the information provided in the main sections. Section 6 Use of pictograms

  3. Each section is preceded by pictograms, which visually represent the content of the section, as follows:

5 19.1. information regarding the main risks covered, provided for in Article 891 paragraph (5) letter b) of Law No. 92/2022, is preceded by the pictogram of an umbrella in white color on a green background or green color on a white background; 19.2. information regarding possible geographical coverage, provided for in Article 891 paragraph (5) letter b) of Law No. 92/2022, is preceded by the pictogram of a globe in white color on a blue background or blue color on a white background; 19.3. information regarding excluded risks, provided for in Article 891 paragraph (5) letter b) of Law No. 92/2022, is preceded by the pictogram consisting of an X-shaped sign in a triangle in white color on a red background or red color on a white background; 19.4. information regarding the main exclusions, provided for in Article 891 paragraph (5) letter d) of Law No. 92/2022, is preceded by the pictogram consisting of an exclamation mark ("!") in a triangle in white color on an orange background or orange color on a white background; 19.5. information regarding obligations valid at the beginning of the contract, during the contract, and in the event of a claim, provided for in Article 891 paragraph (5) letters e) – g) of Law No. 92/2022, is preceded by the pictogram of a handshake in white color on a green background or green color on a white background; 19.6 information regarding methods of paying insurance premiums and the frequency of payments, provided for in Article 891 paragraph (5) letter c) of Law No. 92/2022, is preceded by the pictogram of coins in white color on a yellow background or yellow color on a white background; 19.7. information regarding the duration of the contract, provided for in Article 891 paragraph (5) letter h) of Law No. 92/2022, is preceded by the pictogram of an hourglass in white color on a blue background or blue color on a white background; 19.8. information regarding the method of terminating the contract, provided for in Article 891 paragraph (5) letter i) of Law No. 92/2022, is preceded by the pictogram of a hand on a shield in white color on a black background or black color on a white background. 20. All pictograms specified in point 19 are presented in accordance with the standard presentation format, provided in the annex. 21. If the Insurance Product Information Document is printed or photocopied in black and white, the pictograms provided for in point 19 may be represented in white and black colors. CHAPTER III MANNER OF PROVIDING THE INSURANCE PRODUCT INFORMATION DOCUMENT. CONSUMER INFORMATION CONDITIONS

  1. The Insurance Product Information Document is provided to the consumer free of charge, in Romanian or, if this has been agreed upon explicitly with the consumer, in another language: 22.1. on paper; 22.2. on a durable medium other than paper, if the conditions provided for in point 24 are met; or 22.3. on the official website or in the mobile application, if the conditions provided for in point 25 are met.

In the case where the Insurance Product Information Document is provided on a durable medium other than paper, including through an official website or a mobile application, the consumer has the right, upon request, to receive a free copy on paper, a right which is communicated to the consumer. 24. The Insurance Product Information Document may be provided using a durable medium other than paper, if the following conditions are met: 24.1. the use of the durable medium is appropriate, in the context of the business relationship between the insurance company or insurance intermediary and the consumer; and 24.2. the consumer has been offered the possibility to choose between information on paper and on a durable medium, and has chosen the latter. 25. The Insurance Product Information Document may be provided through an official website or mobile application if it is addressed personally to the consumer or if the following conditions are met: 25.1. the provision of the document through an official website or mobile application is appropriate, in the context of the activity carried out between the professional participant in the insurance market and the consumer; 25.2. the consumer has given consent regarding the provision of information through an official website or mobile application; 25.3. the consumer has been transmitted, via electronic means, the address of the official website and has been informed of the location on the page or in the mobile application, where the respective information can be accessed; 25.4. it is guaranteed that the document remains accessible on the official website/in the mobile application, for the entire period that is reasonably necessary for the consumer to consult it. 26. For the purposes of points 24 and 25, the provision of the Insurance Product Information Document is considered appropriate if there is evidence that the respective consumer has periodic access to the internet. The provision by the consumer of an email address for the purpose of the respective activity is considered such evidence. 27. In the case where an insurance contract is to be concluded through the telephone, the Insurance Product Information Document is provided in accordance with the provisions of the legislation on consumer financial service contracts concluded at a distance. 28. In the situation described in point 27, even if the consumer has chosen to obtain the Insurance Product Information Document on a durable medium other than paper in accordance with point 24, the information is provided by the professional participant in the insurance market to the consumer, in accordance with point 22, immediately after the conclusion of the insurance contract.
