Decision on the Determination of a Buffer for Other Systemically Important Banks

The Bank of Slovenia issued a decision establishing a minimum capital buffer for Other Systemically Important Banks (OSIBs) based on a scoring methodology. The buffer ranges from 0.25% to 1.50% depending on the institution's score, with the possibility for the central bank to impose higher rates up to 0.50 percentage points above the minimum for justified reasons. This decision replaces the previous 2023 regulation and becomes effective on October 10, 2025, with initial application during the 2025 annual review.

Pursuant to Articles 11 and 244 of the Banking Act (Official Gazette of the RS, No. 92/21 and 123/21 – ZBNIP, 2/25 – Constitutional Court decision and 17/25; hereinafter: ZBan-3), the Guidelines on criteria for determining the conditions for the application of Article 131(3) of Directive 2013/36/EU (CRD) in relation to the assessment of other systemically important institutions (OSI) (EBA/GL/2014/10 of 16 December 2014; hereinafter Guidelines) in conjunction with the Decision on the Application of the Guidelines on criteria for determining the conditions for the application of Article 131(3) of Directive 2013/36/EU (CRD) in relation to the assessment of other systemically important institutions (OSI) (Official Gazette of the RS, No. 66/15 and 68/17; hereinafter: Decision on the Application of Guidelines) and Article 31(1) of the Bank of Slovenia Act (Official Gazette of the RS, No. 72/06 – consolidated text, 59/11 and 55/17), the Council of the Bank of Slovenia issues

DECISION

on the determination of a buffer for other systemically important banks

Article 1

(content of the decision)

This decision determines the buffer rates for other systemically important banks (hereinafter: OSIBs).

Article 2

(buffer rates for OSIBs)

The minimum buffer rate for a specific tier is determined based on a point calculation in accordance with the Guidelines and the Decision on the Application of Guidelines, at the following levels:

Article 3

(determination of a higher rate than the minimum)

(1) The Bank of Slovenia determines a buffer rate for each OSIB that is equal to or exceeds the minimum rate from the previous article.

(2) The buffer rate for a specific OSIB may exceed the minimum rate from the previous article by up to 0.50 percentage points if there are justified reasons for doing so.

(3) The Bank of Slovenia shall specifically justify the determination of a higher buffer rate and, in doing so, state the facts, data, and reasons that justify the higher buffer rate.

Article 4

(transitional provision)

The Bank of Slovenia shall first apply the buffer rates for OSIBs from Articles 2 and 3 of this decision during the regular annual review of compliance with the criteria for OSIBs and the appropriateness of the determined buffer rates for OSIBs in the year 2025.

Article 5

(entry into force of the decision)

This decision shall enter into force on the day following its publication.

Article 6

(termination of validity of the decision)

With the entry into force of this decision, the Decision on the Determination of a Buffer for Other Systemically Important Banks (Official Gazette of the RS, No. 79/23 of 21 July 2023) shall cease to be valid.
