Delegation of Power and Amendments to Pakistan Citizenship Rules, 1952

The Federal Government has issued notifications amending the Pakistan Citizenship Rules, 1952, to formally include the Registrar General of Pakistan as an authorized decision-making entity for citizenship matters. These amendments update various application forms and procedures, allowing for affidavit-based evidence in the absence of original documentation. Additionally, a separate order delegates specific powers exercisable by the Federal Government under section 19 of the Pakistan Citizenship Act, 1951, to the Registrar General of Pakistan.

NOTIFICATION

Islamabad, the 20th March, 2024

S. R. O. 516(I)/2024.—In exercise of the powers conferred by section 23 of the Pakistan Citizenship Act, 1951 (II of 1951), the Federal Government is pleased to direct that the following further amendments shall be made in the Pakistan Citizenship Rules, 1952, namely:—

In the aforesaid Rules,—

(1) in rule 2, after the last definition, the following new definition shall be added, namely:—

“Registrar General of Pakistan” means the Chairman of the National Database and Registration Authority appointed as such under sub-section (3) of section 3 of the National Database and Registration Authority Ordinance, 2000 (VIII of 2000);”:

(2) in 13A, in sub-rule (1),—

(a) in clause (iv), after the words “Provincial Government”, the words “or Registrar General of Pakistan” shall be inserted;

(b) after clause (iv), amended as aforesaid, the following new clause shall be inserted, namely:—

“(iva) the Registrar General of Pakistan may, as he deems fit to his satisfaction, cause to make further inquiry;”; and

(c) for clause (v), the following shall be substituted, namely:—

“(v) the Provincial Government or the Federal Government or the Registrar General of Pakistan, as the case may be, shall pass such orders on the recommendation as it or he deems fit.”;

(3) in rule 24, in sub-rule (3), after the word “unless”, the words “confirmed or” shall be inserted;

(4) in Appendix V-A, in form E-1,—

(a) under entry 7, after item (2), the following new item shall be inserted, namely:—

“(3) In case no documentary evidence is available, facts on affidavit on the format attached shall be given.”; and

(b) after entry 12, the following new entry shall be added, namely:—

“13. Other members of his or her family with names and dates of birth.”;

(5) in Appendix V-B, in form E-2, after the words “Secretary to the Government”, occurring twice, the words “or Registrar General of Pakistan” shall be inserted; and

(6) in Appendix-XV, in form Q-1,—

(a) in second paragraph, after the word “certificate”, occurring for the second time, the words “unless confirmed or withdrawn” shall be inserted; and

(b) after the words “Secretary to the Government”, wherever occurring, the words “or Registrar General of Pakistan” shall be inserted.

O. 517(I)/2024.—In exercise of the powers conferred by section 18 of the Pakistan Citizenship Act, 1951 (II of 1951), the Federal Government is pleased to delegate its powers exercisable under section 19 of the said Act to the Registrar General of Pakistan appointed under the National Database and Registration Authority Ordinance, 2000 (VIII of 2000).
