Regarding the submission of Income Tax Return in the context of opening and maintaining fixed deposits exceeding 10 (ten) lakh Taka and investing in Sanchayapatra.

In this regard, reference is made to the letter No. 08.04.0000.012.01.005.14.2830 dated 20 July 2025 of the National Savings Directorate. Accordingly, the replacement of the subject matter regarding investment in Sanchayapatra in Serial No. 22 of Sub-section (3) of Section 264 of Law No. 12 of 2023, which was published in the Gazette on June 02, 2025, by the Ministry of Law, Justice and Parliamentary Affairs, Legislative and Parliamentary Division, is hereby communicated to you for your information and necessary action.

Ordinance

Whereas it is expedient to amend certain laws for effective implementation of Government's financial activities and to achieve the following objectives;

Whereas the Parliament has been dissolved and it appears to the President that circumstances exist rendering it necessary to take immediate action;

Therefore, in exercise of the powers conferred by Article 93(1) of the Constitution of the People's Republic of Bangladesh, the President hereby promulgates and issues the following Ordinance:

117. Amendment of Section 202 of Law No. 12 of 2023.—The word "abuse" mentioned in clause (a) of sub-section (1) of Section 202 of the said Act shall be replaced with the word "misuse".

118. Amendment of Section 244 of Law No. 12 of 2023.—The following sub-section (5) shall be added after sub-section (4) of Section 244 of the said Act, namely:-

"(5) Notwithstanding anything contained in the other provisions of this Act, a Double Taxation Avoidance Agreement shall prevail."

119. Amendment of Section 255 of Law No. 12 of 2023.—The words "amount of said tax" mentioned in sub-section (1) of Section 255 of the said Act shall be replaced with the words "amount of said tax".

120. Amendment of Section 260 of Law No. 12 of 2023.—The following shall be made in Section 260 of the said Act:-

(a) The words "at any airport" mentioned in sub-section (1) shall be inserted with the words "or at any airport outside Bangladesh"; (b) The word "said" mentioned in clause (a) of sub-section (2) shall be replaced with the words "any in Bangladesh".

121. Replacement of Section 264 of Law No. 12 of 2023.—The following shall be made in Section 264 of the said Act:-

(a) The following sub-section (3) shall replace sub-section (3), namely:-

"(3) 'Proof of Submission of Return' shall be submitted in the following cases, namely:-

1. Taking a loan exceeding 20 (twenty) lakh Taka;
2. Becoming a director or sponsoring shareholder of any company;
3. Obtaining or renewing an Import Registration Certificate or Export Registration Certificate;
4. Renewing a trade license in a City Corporation or Municipality area;
5. Renewing a license for a general insurance registered surveyor;
6. Registering the sale, lease, transfer, or deed of gift of land, building, or apartment in a City Corporation, Municipality, or Cantonment Board area;
7. Renewing membership in any recognized professional body as a doctor, dentist, lawyer, chartered accountant, cost and management accountant, chartered secretary, lawyer and tax lawyer, actuary, engineer, architect, or surveyor;

8. Obtaining or renewing a license as a Nikah Registrar under the Muslim Marriages and Divorces (Registration) Act, 1974 (Act No. LII of 1974), Hindu Marriage Registration Act, 2012 (Law No. 40 of 2012), or Registrar under the Special Marriage Act, 1872 (Act No. III of 1872);
9. Obtaining or renewing membership in a trade body or any commercial organization;
10. Renewing a license as a vendor of stamps, court fees, and court paper or as a document writer;
11. Obtaining and renewing drug licenses, fire licenses, environmental clearance, BSTI licenses, bonded warehouse licenses, customs agent licenses, freight forwarding licenses, and registration of warehousing houses;
12. Obtaining and maintaining commercial and industrial gas connections in any area;
13. Obtaining residential gas connections in a City Corporation area;
14. Obtaining electricity connections in a City Corporation or Cantonment Board area;
15. Obtaining and renewing survey certificates for any type of chartered vessel including launches, steamers, fishing trawlers, cargo, coasters, and dump barges;
16. Obtaining and renewing permission for brick production from the Department of Environment or the office of the District Administrator;
17. Admitting children or wards to English medium schools located in City Corporations, District Headquarters, or Municipalities;
18. Obtaining and renewing agency or distributorship of a company;
19. Opening letters of credit for the purpose of import;
20. Opening letters of credit for the purpose of import;
21. Opening and maintaining fixed deposits exceeding 10 (ten) lakh Taka;
22. Purchasing Sanchayapatra exceeding 10 (ten) lakh Taka;
23. Participating in elections for Municipalities, Upazilas, District Councils, City Corporations, or the National Parliament;
24. Receiving salaries and allowances of persons employed in positions supervising management, administrative, or production activities;---
