Oregon DFR Bulletin 2025-3: Director’s Expectations for Health Benefit Plans Under the Reproductive Health Equity Act

The Oregon Division of Financial Regulation issued Bulletin 2025-3 to clarify that health benefit plans must provide coverage without cost sharing for all services mandated by the Oregon Reproductive Health Equity Act. The bulletin requires carriers to cover FDA-approved contraceptives without prior authorization or medical management, while permitting coverage of therapeutic equivalents only when an enrollee's provider determines an alternative is medically necessary. Additionally, the guidance prohibits restrictions based on sex or gender for preventive screenings and bans unreasonable medical management techniques that would indiscriminately deny coverage for RHEA-listed services.
