REGULATION on Bank Identification Codes of Payment System Participants of the Kyrgyz Republic
General Provisions 1.1. (Expired in accordance with the Resolution of the Board of the National Bank dated June 8, 2017 No. 2017-P-14\23-11-(PS).) 1.2. This Regulation on Bank Identification Codes of Payment System Participants of the Kyrgyz Republic (hereinafter, the "Regulation") defines the structure of the Bank Identification Code (hereinafter, "BIC") of payment system participants and their branches, the structure of the BIC Reference Book (hereinafter, "BIC Reference Book"), and the procedure for providing it to participants and payment system operators. 1.3. This Regulation applies to payment system participants of the Kyrgyz Republic and their branches conducting payments in national currency within the territory of the Kyrgyz Republic.
Basic Definitions 2.1. The BIC is a unique identifier of a payment system participant and its branches, serving to ensure payment routing and delivery to payment system participants of the Kyrgyz Republic. 2.2. The BIC is used in payment documents when conducting non-cash payments within the territory of the Kyrgyz Republic, in accordance with the legislation of the Kyrgyz Republic and regulatory legal acts of the National Bank of the Kyrgyz Republic (hereinafter, "National Bank"). 2.3. The BIC Reference Book includes a systematic list of payment system participants and their branches conducting payments within the Kyrgyz Republic's payment system, specifying their bank identification codes and other details. 2.4. For the purposes of this Regulation, payment system participants of the Kyrgyz Republic (hereinafter, "Participant") include:
Structure of the Bank Identification Code 3.1. The BIC consists of six digits, unique within the Kyrgyz Republic's payment system, and has the following structure: 1st-3rd digits from the left - Participant number in the payment system. The first digit cannot be zero and takes numeric values from "100" to "999". 4th-6th digits from the left - Branch number of the Participant in the payment system. Takes numeric values from "001" to "999". 3.2. The National Bank assigns BICs to Participants and branches of Participants.
BIC Reference Book 4.1. The BIC Reference Book is a departmental reference book of the National Bank. 4.2. Data contained in the BIC Reference Book are used when filling out payment documents and performing procedures to verify their correctness, and also reflect information on the current status of Participants and branches of Participants in the Kyrgyz Republic's payment system. 4.3. The National Bank maintains the BIC Reference Book. 4.4. Maintaining the electronic database of the BIC Reference Book provides for its reproduction on paper media.
Details of Payment System Participants in the BIC Reference Book 5.1. Field "BIC". The "BIC" field corresponds to the BIC of a Participant or branch of a Participant. 5.2. Field "BIC SWIFT". The "BIC SWIFT" field corresponds to the BIC of a SWIFT community member and is assigned in accordance with the International Bank Identification Codes Reference Book published quarterly by SWIFT. The "BIC SWIFT" field is used to ensure the ability to conduct interbank payments in the national payment system via SWIFT message transmission telecommunications systems. 5.3. Field "Participant Type". For Participants, the "Participant Type" field is set as follows: "1" - for the National Bank; "2" - for Participants providing banking services to individuals and legal entities based on licenses issued by the National Bank; "3" - for branches of Participants providing banking services to individuals and legal entities; "4" - for the Central Treasury of the Ministry of Finance of the Kyrgyz Republic; "7" - for financial-credit institutions that are not residents of the Kyrgyz Republic and are not licensed by the National Bank (e.g., Interstate Bank). As the range of Participant types expands, values of the BIC Reference Book field will be supplemented. 5.4. Field "Account Number". The "Account Number" field corresponds to the number of the correspondent account(s) of a Participant opened in the National Bank. For branches of a Participant, the "Account Number" field corresponds to the number of the correspondent account of the Participant. 5.5. Field "Name". The "Name" field corresponds to the name of a Participant or branch of a Participant. 5.6. Field "Participation in Payments and Settlements". The "Participation in Payments and Settlements" field reflects information on participation in payment and settlement systems. For Participants, the "Participation in Payments and Settlements" field is established in accordance with contractual relations between Participants, and between Participants and the National Bank. 5.7. Field "Address". The "Address" field contains information on the address (location) of a Participant or branch of a Participant. 5.8. Field "Status". The "Status" field indicates the current status of a Participant in conducting settlements and payment operations within the territory of the Kyrgyz Republic, and indicates restrictions or cessation of payment operations by a Participant. Values that the "Status" field may indicate for each of the payment systems: "active" indicates no restrictions on conducting payment operations by Participants; "restrictions applied" indicates temporary restrictions on conducting certain payment operations by Participants; "suspended" means temporary cessation of all payment operations by Participants until specific instructions from the National Bank; "closed" indicates cessation of payment operations by a Participant or changes in "BIC" values due to reorganization. The "Note" field for this field provides additional information clarifying the meaning of the "Status" field for a Participant. 5.9. Field "Successor BIC". The "Successor BIC" field is indicated in case of reorganization of Participants in accordance with the legislation of the Kyrgyz Republic. 5.10. The list of details of payment system participants in the BIC Reference Book is provided in Appendix 1 to this Regulation.
Maintenance and Provision of the BIC Reference Book The procedure for maintaining the BIC Reference Book is determined by internal procedures of the National Bank. Conditions for providing the BIC Reference Book (method and delivery terms) to Participants are based on contractual relations between a Participant and the National Bank.
