The Prudential Control and Resolution Authority issued Instruction No. 2017-I-21 to mandate that regulated financial institutions complete an annual questionnaire on commercial practices and customer protection. The instruction defines the scope of applicable entities, specifies the four-part structure of the questionnaire covering identification, activities, practices, and internal controls, and sets the submission deadline for June 30 each year. It also grants exemptions for certain B2B-only or specific niche activities and formally repeals the previous 2015 instruction.

Article 1: The following are hereinafter referred to as "subject entities":
Credit institutions, with the exception of establishments and branches authorized to carry out their activities in the Principality of Monaco, of establishments whose authorization is limited to the services of clearing of financial instruments and custody and;
Financing companies mentioned in II of Article L. 511-1 of the Code Monetary and Financial Code with the exception of financing companies authorized to deliver, as a main activity, guarantees;
The bodies mentioned in 5 of Article L. 511-6 of the Monetary and Financial Code;
Companies carrying out a direct insurance activity mentioned in Article L. 310-1 of the Insurance Code and the companies mentioned in the last paragraph of the same article, with the exception of insurance bodies not falling under the regime known as "Solvency II" within the meaning of Articles L.310-3-1 and L.310-3-2 of the code of insurance;
Mutual societies and unions that carry out operations falling under 1°) of I of Article L. 111-1 of the Mutual Code, with the exception of bodies totally substituted and bodies not falling under the regime known as "Solvency II" within the meaning of Articles L.211-10 and L.211-11 of the mutual code;
Provident institutions and unions that carry out operations falling under Article L. 931-1 of the Social Security Code, with the exception of bodies not falling under the regime known as "Solvency II" within the meaning of Articles L.931-6 and L.931- 6-1 of the social security code;
Persons mentioned in Article L. 612-2 III of the Monetary and Financial Code exercising in France under the right of establishment.
Article 2: Subject entities must respond to the questionnaire on activities and commercial practices and on customer protection rules appearing in Annex 1 for the banking, payment services and investment services sector or in Annex 2, for the insurance sector, under the conditions specified in Articles 3, 4 and 5 of this instruction. The questionnaire comprises four parts:
Article 3: The following entities are exempt from responding to parts II to IV of the questionnaire, after having completed part I (Identification Data):
Article 4: Submission of the questionnaire response to the ACPR: The response to the questionnaire is sent to the General Secretariat of the ACPR under electronic form, according to the procedures indicated by it, by each subject possessing an interbank code for entities in the banking sector and by each subject possessing a SIREN number for entities in the insurance sector. It is validated by an effective manager or the person he has authorized for this purpose. The response to the questionnaire is submitted to the ACPR no later than June 30 of each year.
Article 5: This instruction repeals Instruction No. 2015-I-22 as of its publication in the Official Register of the Prudential Control and Resolution Authority.
