Notice on Filing Motor Vehicle Insurance Endorsements Under Section 71 of the Insurers Act

The Autorité des marchés financiers (AMF) has amended the filing requirements for motor vehicle insurance endorsements under section 71 of the Insurers Act. Effective January 1, 2025, authorized insurers will submit these endorsements annually on December 1 instead of the previous biannual schedule. This adjustment reduces compliance burdens while maintaining AMF oversight of endorsements that stipulate terms solely for the insureds' benefit.

Notice regarding the filing of endorsements with the AMF pursuant to section 71 of the Insurers Act Under section 71 of the Insurers Act, the form and terms of insurance policies relating to the ownership or use of motor vehicles must be determined by the Autorité des marchés financiers (the “AMF”). The same is true for any riders (“endorsements”) that may be attached to those policies. However, an authorized insurer may attach an endorsement whose form and terms are not determined by the Authority to such a policy if the endorsement provides for terms stipulated solely for the benefit of the insureds and it has been sent to the Authority. The AMF must approve each such endorsement, including its terms and conditions of application, in a letter sent to the insurer. Up to now, the AMF has asked in that letter that the insurer send it a copy of such endorsements twice a year, on June 1 and December 1, so that it can verify that they are still compliant. In keeping with its initiatives under its 2021-2025 Strategic Plan to optimize compliance burden and in response to insurers’ comments, the AMF hereby notifies the insurers concerned that, effective January 1, 2025, such endorsements will only need to be sent to the AMF once a year, on December 1.
