Order to EstatePartner A/S and EstatePartner Forvaltning ApS Regarding Unlawful Business

The Danish Financial Supervisory Authority ordered EstatePartner A/S and EstatePartner Forvaltning ApS to legalize their unauthorized management of alternative investment funds, citing violations of the Act on Alternative Investment Funds. The companies appealed the decision to the Business Appeals Board, which subsequently upheld both the finding of unlawful fund management and the regulatory order to regularize their operations. The Authority published this notification in accordance with statutory requirements following the appellate ruling.

11-03-2024 The Danish Financial Supervisory Authority assesses that EstatePartner A/S and/or EstatePartner Forvaltning ApS are managing alternative investment funds. EstatePartner A/S and/or EstatePartner Forvaltning ApS do not hold authorization or are registered with the Danish Financial Supervisory Authority as managers of alternative investment funds, therefore the Danish Financial Supervisory Authority orders EstatePartner A/S and EstatePartner Forvaltning ApS to legalize the situation. The Danish Financial Supervisory Authority made a decision on 6 March 2024 that EstatePartner A/S and/or EstatePartner Forvaltning ApS are managing alternative investment funds without authorization or registration with the Danish Financial Supervisory Authority as managers of alternative investment funds, pursuant to Section 11(1) and Section 9(1) of the Act on Alternative Investment Funds.

The Danish Financial Supervisory Authority has therefore ordered EstatePartner A/S and EstatePartner Forvaltning ApS to legalize the situation.

The Danish Financial Supervisory Authority's notification of the decision is made in accordance with Section 172(2) of the Act on Alternative Investment Funds.

EstatePartner A/S and EstatePartner Forvaltning ApS have appealed the decision to the Business Appeals Board and have requested the Danish Financial Supervisory Authority to publish this.

By ruling of 27 April 2026, the Business Appeals Board upheld that EstatePartner A/S and/or EstatePartner Forvaltning ApS are managing alternative investment funds, as well as the orders issued by the Danish Financial Supervisory Authority requiring EstatePartner A/S and EstatePartner Forvaltning ApS to legalize the situation.
