Amendments to Policy Statement to Regulation 31-103 Respecting Registration Requirements, Exemptions and Ongoing Registrant Obligations

Regulatory authorities have amended Policy Statement to Regulation 31-103 to facilitate the transition for Québec mutual fund dealers to the new Self-Regulatory Organization. The changes insert specific exceptions for registered dealing representatives of mutual fund dealers in Québec within Section 3.16 regarding SRO provisions. Additionally, Section 9.4 is modified to exclude Québec from MFDA member references and redefine membership status for individuals registered in other jurisdictions.

AMENDMENTS TO POLICY STATEMENT TO REGULATION 31-103 RESPECTING REGISTRATION REQUIREMENTS, EXEMPTIONS AND ONGOING REGISTRANT OBLIGATIONS

  1. Section 3.16 of Policy statement to Regulation 31-103 respecting Registration Requirements, Exemptions and Ongoing Registrant Obligations is amended by inserting, in the fourth paragraph, “, except for registered individuals who are dealing representatives of a mutual fund dealer, for their activities in Québec.” after “(SRO provisions)”.
  2. Section 9.4 of the Policy Statement is amended: (1) by inserting, in the second paragraph, “(except in Québec)” after “MFDA members”; (2) by replacing, in the seventh paragraph, “are MFDA members” by “are also registered in that category in another jurisdiction”.
