The Prudential Control and Resolution Authority issued Instruction No. 2021-I-10 to amend the regulatory framework for electronic money institutions by replacing the standard application forms for authorization and simplified authorization. This update modifies Annexes I and II of Instruction No. 2013-I-09 to reflect current procedural requirements for establishing or providing services within the European Union or EEA. The instruction entered into force the day following its publication in the Authority's official register on October 7, 2021.

The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, particularly Articles L. 612-2 and L. 612-24; Having regard to the Order of May 2, 2013, concerning the prudential regulation of electronic money institutions; Having regard to Instruction No. 2013-I-09 of July 12, 2013, regarding application forms for requests for authorization, agent declaration, as well as notification of freedom of establishment, freedom to provide services, use of an agent, and recourse to a distributor in another Member State of the European Union or in another State party to the agreement on the European Economic Area for an electronic money institution; Having regard to the opinion of the Consultative Commission on Prudential Affairs of September 22, 2021,
DECIDES
Article 1: The standard file for the request for authorization as an electronic money institution, referred to in Article 2 of the aforementioned Order of May 2, 2013, and present in Annex I of the aforementioned Instruction No. 2013-I-09, is replaced by the standard file appearing in Annex I of this Instruction.
Article 2: The standard file for the request for simplified authorization as an electronic money institution, referred to in Article 2-1 of the aforementioned Order of May 2, 2013, and present in Annex II of the aforementioned Instruction No. 2013-I-09, is replaced by the standard file appearing in Annex II of this Instruction.

Article 3: This Instruction shall enter into application the day following its publication in the official register of the Prudential Control and Resolution Authority.
