Prohibitions and Restrictions on Proprietary Trading and Certain Interests in Hedge Funds and Covered Funds

The Commodity Futures Trading Commission issued a proposed rulemaking to implement Section 619 of the Dodd-Frank Act, which prohibits banking entities from engaging in proprietary trading and restricts their interests in hedge funds and private equity funds. The proposal adopts the joint rule text developed with other federal agencies while incorporating CFTC-specific modifications and additional questions regarding applicability to CFTC-regulated entities. The Commission is soliciting public comments on all aspects of this proposed rule by April 16, 2012, to ensure consistent implementation of the statutory prohibitions and exemptions.
