Decision Defining the Form and Contents of the Statement of Fees

The Governor of the National Bank of Serbia issued this Decision to mandate the specific form, contents, and delivery timelines for annual fee statements provided to payment service users. Payment service providers are required to compile separate statements for each account using prescribed schedules that detail all charged fees and applicable interest rates for both consumers and entrepreneurs. These statements must be sent to consumers by March 1 of the following year or immediately upon account closure, while statements for entrepreneurs are issued only upon request.

RS Official Gazette, No 99/2018 Pursuant to Article 73e, paragraph 10 of the Law on Payment Services (RS Official Gazette Nos 139/2014 and 44/2018) and Article 18, paragraph 1, item 3) of the Law on the National Bank of Serbia (RS Official Gazette, Nos 72/2003, 55/2004, 85/2005 – other law, 44/2010, 76/2012, 106/2012, 14/2015, 40/2015 ‒ CC decision and 44/2018), the Governor of the National Bank of Serbia hereby issues this DECISION DEFINING THE FORM AND CONTENTS OF THE STATEMENT OF FEES

  1. This Decision sets out the form and contents of the statement of fees charged for the services linked with the payment account which the payment service provider provided to the payment service user during the calendar year (hereinafter: statement of fees). In its statement of fees the payment service provider shall include all fees which the payment service user was charged for the services provided; the statement shall also include data on all interest rates which the payment service provider charged to the payment service user, as well as all interest rates which the payment service provider paid to the payment service user.
  2. The payment service provider shall compile the statement of fees using the following forms:
  1. Statement of fees for the payment service user – consumer, defined in Schedule 1, printed with this Decision and integral hereto;
  2. Statement of fees for the payment service user – entrepreneur/legal person, defined in Schedule 2, printed with this Decision and integral hereto.
  1. The payment service provider shall compile a separate statement of fees for each payment account or payment account package of the payment service user.
  2. The payment service provider shall compile the statement of fees according to the instructions provided in Schedule 3, printed with this Decision and integral hereto.
  3. The payment service provider shall send the statement of fees to the payment service user – consumer at least once a year, and no later than 1 March of the current year for the prior calendar year.

2 Notwithstanding paragraph 1 of this Section, in case of payment account closing, once the account has been closed, the payment service provider shall immediately send the statement of fees to the payment service user – consumer pertaining to that payment account, for the period until the day of closing the account, and no later than 30 days from the day the payment account was closed. The payment service provider shall send the statement of fees to the payment service user – entrepreneur/legal person at its request. 6. Notwithstanding Section 5 of this Decision, by 1 March 2020 the payment service provider shall send the statement of fees to each payment service user – consumer, as well as to each payment service user – entrepreneur/legal person who requested it, for all services that have been provided to them between 1 January and 31 December 2019. 7. This Decision shall enter into force on the eighth day following its publication in the RS Official Gazette and shall apply as of 17 March 2019. D.
