FEPD Circular Letter No. 06: Export subsidy against export of Software, ITES and Hardware

The Export Policy Division of the Ministry of Commerce clarifies that Export Registration Certificates (ERCs) are not required for the export of non-physical forms of Software and ITES. This directive aligns with the instructions issued by the Ministry of Commerce in its circular letter dated November 28, 2022, and is issued for the information of all concerned parties.

In accordance with the instructions of the Export Policy Division, Ministry of Commerce, Circular Letter No. 03, dated 08 December 2018,

02. It is clarified that Export Registration Certificates (ERCs) are not required for the export of non-physical forms of Software, Information Technology Enabled Services (ITES), and Hardware. Accordingly, the Bangladesh Bank has issued a circular letter dated 17 July 2023, reference number 26.03.0000.004.22.004.21.46, stating that the requirement for Export Registration Certificates (ERCs) for the export of Software and ITES in non-physical form shall not apply.

01. In reference to the instructions contained in the Ministry of Commerce's circular letter dated 28 November 2022, reference number 26.00.0000.101.08.019.20.129, it is hereby clarified that Export Registration Certificates (ERCs) are not required for the export of Non-Physical Form (Software and ITES) from the Directorate General of Foreign Trade.
