Financial Intermediation Institutions – Requirements for Opening Current Accounts – Article 390 of the RNRCSF

The Superintendency of Financial Services replaced Article 390 of the RNRCSF, imposing specific identification and due diligence requirements on financial intermediation institutions for opening current accounts. Institutions must collect detailed personal or corporate data, verify moral solvency and activity, and cross-reference applicants against the Central Bank of Uruguay’s register of check infractions. These obligations apply to all financial intermediation institutions subject to the regulation.

Montevideo, August 22, 2024 Ref: FINANCIAL INTERMEDIATION INSTITUTIONS – REQUIREMENTS FOR OPENING CURRENT ACCOUNTS – ARTICLE 390 OF THE RNRCSF

The market is informed that, on August 9, 2024, the Superintendency of Financial Services adopted the following resolution:

  1. REPLACE in Title VI – Current Accounts of Book IV – Protection of the user of financial services, Article 390 with the following:

ARTICLE 390 (REQUIREMENTS).

For the opening of current accounts, financial intermediation institutions must comply with the following requirements:

a) Properly identify their holders and orderers, obtaining, as a minimum, the following data from each of them:

  1. Natural Persons a. full name; b. date and place of birth; c. marital status (if married, name of the spouse); d. address; e. profession, trade, or main activity; f. identity document.

  2. Legal Entities a. name or trade name; b. date of incorporation; c. main activity; d. address; e. registration number in the Single Tax Registry, if such registration applies; f. practice documentation (authenticated copy of the contract or statutes, registration certificate, authorities, authorized representatives, powers of attorney, etc.).

b) Obtain information, to the satisfaction of the financial intermediation institution, regarding the moral solvency and activity of each of the holders and orderers of the current account to be opened.

c) Complement the information referred to in the previous section with any antecedents they may have in the register of infractions in the use of checks, which the Central Bank of Uruguay makes known in accordance with Article 425.
