Instruction No. 2019-I-09 of April 18, 2019 amending Instruction No. 2015-I-12 regarding communication to the ACPR of the LEI
This instruction amends Instruction No. 2015-I-12 by adding additional retirement fund entities to the list of organizations required to communicate their Legal Entity Identifier (LEI) to the ACPR. It replaces the submission procedures to mandate electronic filing via the Autorisations portal with supporting documentation, and requires the LEI to be indicated in all relevant documents submitted to the ACPR. These changes apply to the specified insurance and retirement organizations and enter into effect on May 1, 2019.
PRUDENTIAL CONTROL AND RESOLUTION AUTHORITY
Instruction No. 2019-I-09 amending Instruction No. 2015-I-12 of April 21, 2015 regarding the communication to the ACPR of the international "legal entity identifier" by insurance organizations
The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, in particular Articles L. 612-2 and L. 612-24; Having regard to the Insurance Code, in particular Article L. 381-1; Having regard to the Mutual Code, in particular Article L. 214-1; Having regard to the Social Security Code, in particular Article L. 942-1; Having regard to Instruction No. 2015-I-12 of April 21, 2015 regarding the communication to the ACPR of the international "legal entity identifier" by insurance organizations; Having regard to the opinion of the Prudential Affairs Consultative Commission of April 3, 2019, DECIDES
Article 1: Article 1 of the aforementioned Instruction No. 2015-I-12 is supplemented by a paragraph drafted as follows: "6° Additional professional retirement funds, additional professional retirement institutions, or mutuals or unions of additional professional retirement."
Article 2: Article 2 of the aforementioned Instruction No. 2015-I-12 is replaced by the following provisions: "The organizations subject to this instruction shall send the standard file 'Legal Entity Identifier Declaration Form' to the ACPR accompanied by supporting documentation (certificate, invoice) provided upon obtaining the identifier. This file must be sent in electronic format to the Prudential Control and Resolution Authority by depositing it on the Autorisations portal at the address: https://acpr-autorisations.banque-france.fr/."
Article 3: Article 3 of the aforementioned Instruction No. 2015-I-12 is replaced by the following provisions: "The organizations subject to this instruction must indicate their LEI to the ACPR in all documents sent to it and in which the LEI is required, at the dates of submission of these documents."
Article 4: The annex to the aforementioned Instruction No. 2015-I-12 is replaced by the annex to this instruction.
Article 5: This instruction enters into application on May 1, 2019.
