Instruction No. 2024-I-05 of April 19, 2024, on the withdrawal of approval, authorization, or registration of financing companies, third-party financing companies, investment firms, payment institutions, account information service providers, electronic money institutions, or credit managers

The Prudential Control and Resolution Authority issued Instruction No. 2024-I-05 to establish the procedural requirements for the withdrawal of approval, authorization, or registration for specified financial entities. The instruction mandates that affected institutions, including financing companies and payment institutions, submit a complete application dossier using the designated electronic form via the ACPR portal. This directive supersedes the previous 2018 instruction and entered into force the day following its publication in the Authority's Official Register.

PRUDENTIAL CONTROL AND RESOLUTION AUTHORITY

Instruction No. 2024-I-05 regarding the withdrawal of approval, authorization, or registration of financing companies, third-party financing companies, investment firms, payment institutions, account information service providers, electronic money institutions, or credit managers modified by Instruction No. 2024-I-13 of October 24, 2024

The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, particularly Articles L. 511-15-1, L. 522-11, L. 522-11-3, L. 526-14 and following, L. 532-6, L. 54-11-5; Having regard to Article R. 518-71-II of the Monetary and Financial Code; Having regard to the Order of October 29, 2009, concerning the prudential regulation of payment institutions; Having regard to the Order of May 2, 2013, concerning the prudential regulation of electronic money institutions; Having regard to the Order of December 4, 2017, relating to the approval, changes in status, withdrawal of approval, and deregistration of investment firms and similar institutions; Having regard to the Order of December 4, 2017, relating to the approval, changes in status, withdrawal of approval, and deregistration of financing companies, as well as to the declarative obligations of certain financial institutions; Having regard to the opinion of the Prudential Affairs Consultative Committee of March 27, 2024, DECIDES

Article 1: The following are hereinafter referred to as "subject institutions and bodies": 1° Financing companies referred to in Section II of Article L. 511-1 of the Monetary and Financial Code; 2° Third-party financing companies referred to in Article L. 511-6 of the same Code;

3° Investment firms referred to in Article L. 531-4 of the same Code; 4° Payment institutions referred to in Article L. 522-1-I of the same Code; 5° Account information service providers referred to in Article L. 522-1-II of the same Code; 6° Electronic money institutions referred to in Article L. 526-1 of the same Code; 7° Credit managers referred to in Article L. 54-11-1, 4°, of the same Code.

Article 2: Subject institutions and bodies referred to in Article 1 that request the competent authority for the withdrawal of their approval shall submit to the Prudential Control and Resolution Authority a complete application file using the form attached to the annex of this instruction.

Article 3: The form and supplementary documents, duly completed and signed, must be sent in electronic format to the Prudential Control and Resolution Authority by depositing them on the portal accessible at the following address: https://acpr-portail.banque-france.fr

Article 4: This instruction repeals the modified Instruction No. 2018-I-07 of July 9, 2018 regarding the withdrawal of approval, authorization, or registration of financing companies, third-party financing companies, investment firms, payment institutions, account information service providers, or electronic money institutions. References to Instruction No. 2018-I-07 shall be understood as references to this instruction.

Article 5: This instruction enters into application the day following its publication in the Official Register of the Prudential Control and Resolution Authority.
