Instruction No. 4/2023 BO No. 2/2023 Supplement • 2023/02/24 .................................................................................................................................................................................................. Topics Banking Operations :: Deposits and Withdrawals of Banknotes Mod. 99999911/T – 01/14 Index Text of the Instruction Annex I to the Instruction - Hours and locations for deposit and withdrawal of banknotes and metal coins Annex II to the Instruction - Compliance with the duty to inform the data subject Text of the Instruction Subject: Deposit and withdrawal operations of euro banknotes and metal coins at the Bank of Portugal

Article 6(1) of the Organic Law of the Bank of Portugal provides that, "in accordance with Article 106 of the Treaty establishing the European Community, the Bank issues banknotes with legal tender and discharge power."

A combined reading of this article with Article 128(1) of the Treaty on the Functioning of the European Union (TFEU) and Article 16 of Protocol No. 4 annexed to the TFEU, which establishes the Statute of the European System of Central Banks (ESCB), reveals that the right to authorize the issuance of euro banknotes in the Union, held by the European Central Bank (ECB), includes the competence to adopt measures to protect the integrity of euro banknotes.

The recitals of the ECB Decision of 16 September 2010 on the verification of authenticity and quality and the recirculation of euro banknotes (ECB/2010/14) add to the legal basis referred to above, reinforcing the need for each National Central Bank to ensure that euro banknotes in circulation are genuine and in good condition of preservation.

To guarantee the genuineness of euro banknotes in circulation, they must also be kept in good condition of preservation; therefore, the quality control of euro banknotes is essential so that the general public can easily verify the integrity of the banknotes made available to them. In this regard, national law also establishes, in Article 10 of Decree-Law No. 195/2007 of 15 May, which regulates the activity of recirculation of euro banknotes carried out by all entities operating professionally with cash, the duty to return to the Bank of Portugal euro banknotes that do not meet the minimum quality requirements to remain in circulation or that have not been submitted to any of the verification processes provided for.

Regarding the issuance of metal coins, Regulation (EU) No 651/2012 of the European Parliament and of the Council of 4 July 2012 on the issuance of euro coins determines that Member States may issue current or commemorative euro coins.

Instruction No. 4/2023 BO No. 2/2023 Supplement • 2023/02/24 Topics Banking Operations :: Deposits and Withdrawals of Banknotes .................................................................................................................................................................................................. Mod. 99999911/T – 01/14 In this context, the Bank of Portugal has been assigned, as determined by Articles 6(2) and (3) of its Organic Law, the competence to put "metal coins into circulation, including commemorative ones (...) through and upon requisition of the Bank."

Regulation (EU) No 1210/2010 of the European Parliament and of the Council of 15 December 2010 on the authentication of euro coins and the handling of euro coins unfit for circulation determines, in Article 3(2), that "following authentication, all euro coins suspected to be counterfeit and euro coins unfit for circulation are presented to the designated national authority." Such coins, in accordance with Article 9 of Decree-Law No. 184/2007 of 10 May, a decree-law regulating the activity of recirculation of euro coins developed by all entities operating professionally with cash, "must be deposited with the Bank of Portugal, in accordance with the rules regarding quantities and packaging to be defined by instruction of the Bank of Portugal."

Considering the foregoing, this instruction aims to regulate the operationalization of the functions of the Bank of Portugal, both as the issuer of euro banknotes within the Eurosystem, and in the context of placing metal coins into circulation, in accordance with the responsibilities assigned and internally defined by the Portuguese State, as well as as the entity with responsibilities for preserving the integrity of euro banknotes and metal coins.

Given the extent of the changes to be introduced, the Bank of Portugal proceeds to revoke Instruction No. 18/2021 of 15 December, which will be replaced by this new Instruction.

Thus, in accordance with Articles 6(1) to (3) of the Organic Law of the Bank of Portugal, Article 128(1) of the Treaty on the Functioning of the European Union and Article 16 of Protocol No. 4 annexed thereto, Article 2(1) of Regulation (EU) No 651/2012 of the European Parliament and of the Council of 4 July on the issuance of euro coins, and Article 3(2) of Regulation (EU) No 1210/2010 of the European Parliament and of the Council of 15 December 2010 on the authentication of euro coins and the handling of euro coins unfit for circulation, and also in accordance with Article 10 of Decree-Law No. 195/2007 of 15 May and Article 9 of Decree-Law No. 184/2007 of 10 May, the Bank of Portugal determines:
