Text of the Instruction Subject: Members of agricultural credit boxes

Instruction No. 17/2009 of the Bank of Portugal regulates the monitoring of compliance with the limits regarding the number of members, defined in Article 19, paragraphs 3 and 4, of the Legal Regime of Mutual Agricultural Credit (RJCAM), as amended by Decree-Law No. 142/2009 of June 16.

Paragraph 3 of the aforementioned article allows the association with an agricultural credit box of natural or legal persons who do not meet the requirements defined in paragraph 1 of that article, provided they carry out activity or have residence within its area of action. However, a limit of 35% of the total number of members is established, which may, in exceptional cases, be raised to 50% with the authorization of the Bank of Portugal.

In this context, this Instruction, with a view to standardizing reports to the Bank of Portugal, in line with European best practices, establishes that the report must henceforth be submitted to the Bank of Portugal through the BPnet system and in XBRL format, maintaining the same information to be reported and adapting the table contained in the annex of Instruction No. 17/2009 of the Bank of Portugal of October 15, in conformity, which implies only a change in the submission format.

Thus, the Bank of Portugal determines, in the exercise of the competence attributed to it by Article 17, paragraph 1, of its Organic Law, approved by Law No. 5/98 of January 31, in its current wording, and under the provisions of Article 120 of the General Regime of Credit Institutions and Financial Companies (RGICSF), approved by Decree-Law No. 298/92 of December 31, the following:

Article 1. Object and Scope This Instruction amends Instruction No. 17/2009 of the Bank of Portugal, which regulates the monitoring of compliance with the limits defined in paragraphs 3 and 4 of Article 19 of the RJCAM.

Article 2. Amendment of Instruction No. 17/2009 of the Bank of Portugal Paragraph 2 of Instruction No. 17/2009 of the Bank of Portugal shall henceforth read as follows:

«2. The informational elements referred to in the preceding paragraph are defined in the table in the annex, and must be submitted to the Bank of Portugal through the BPnet system and in XBRL format, in observance of the technical specifications available on the Bank of Portugal’s website under "Reporting Obligations of Supervised Institutions."»

Article 3. Revocation of Article 3 and Amendment of Article 4 of Instruction No. 17/2009 of the Bank of Portugal Article 3 of Instruction No. 17/2009 of the Bank of Portugal is revoked, being replaced by the current Article 4.

Article 4. Amendment to the Annex of Instruction No. 17/2009 of the Bank of Portugal The annex of Instruction No. 17/2009 of the Bank of Portugal is amended according to the wording contained in the annex to this Instruction, which forms an integral part thereof.

Article 5. Entry into Force This Instruction enters into force on the day following its publication and applies, for the first time, to the report with a reference date of June 30, 2020.
