These Instructions, issued by the Ministry of Industry and Trade, establish definitions for key terms such as the Law, the Commission, the Council, the Secretary, the Minister, and the Director under Law No. 33 of 1999. The document grants the Competition Commission the authority to request information, documents, or data from any person, including parties to economic concentrations, agreements, or restrictive practices, necessary for exercising its powers. Article 1: These instructions shall be called (Instructions for the Protection of Competition and Prevention of Monopolistic Practices of 2005) and shall come into force from the date of their publication in the Official Gazette.
Article 2: The following words and phrases, wherever they appear in these instructions, shall have the meanings assigned to them below, unless the context indicates otherwise, and for the purposes of Law No. (33) of 1999 on the Protection of Competition and Prevention of Monopolistic Practices: a- The Law: The Law on the Protection of Competition and Prevention of Monopolistic Practices No. 33 of 1999. b- The Commission: The Competition Commission established pursuant to the provisions of Article (5) of the Law. c- The Council: The Competition Council formed in accordance with the provisions of Article (7) of the Law. d- The Secretary: The Secretary of the Competition Council appointed in accordance with the provisions of Article (7) of the Law. e- The Minister: The Minister of Industry and Trade. f- The Director: The Director of the Competition Directorate in the Ministry of Industry and Trade, appointed in accordance with the provisions of Article (1) of the Instructions for the Formation of the Competition Directorate No. (4709) of 2005, published in the Official Gazette No. (2232) of 2005, and the amendments thereto, including the Instructions for the Formation of the Competition Directorate No. (4945) of 2009, published in the Official Gazette No. (6601) of 2009, and the Instructions for the Formation of the Competition Directorate No. (5028) of 2010, published in the Official Gazette No. (2) of 2010.
Article 3: The Commission shall, for the purposes of implementing the provisions of the Law, have the right to request from any person, including the parties to the economic concentration, the parties to the agreement, the parties to the abuse of dominant position, the parties to the restrictive practices, and any other person, any information, documents, or data it deems necessary for the exercise of its powers and duties,
