Law Modifying Article 207 of Law 27444, General Administrative Procedure Law, to Reduce the Term for Resolving Reconsideration Appeals

Law No. 31603 modifies Article 207 of Law 27444, the General Administrative Procedure Law, to reduce the resolution term for reconsideration appeals. While the general term for resolving administrative appeals remains thirty (30) days, reconsideration appeals must now be resolved within fifteen (15) days. The Executive Power is required to adapt the Consolidated Text and Regulations of Law 27444 to these modifications within a maximum period of thirty (30) business days.

Law No. 31603 THE PRESIDENT OF THE REPUBLIC WHEREAS: THE CONGRESS OF THE REPUBLIC; Has enacted the following Law: LAW THAT MODIFIES ARTICLE 207 OF LAW 27444, GENERAL ADMINISTRATIVE PROCEDURE LAW, IN ORDER TO REDUCE THE TERM FOR RESOLVING THE RECONSIDERATION APPEAL Sole Article.- Modification of Article 207 of Law 27444, General Administrative Procedure Law Article 207 of Law 27444, General Administrative Procedure Law, is modified in the following terms: "Article 207. Administrative Appeals 207.1 Administrative appeals are: a) Reconsideration appeal b) Appeal Only if expressly established by law or legislative decree, may an administrative review appeal be filed. 207.2 The term for filing appeals is fifteen (15) peremptory days, and they must be resolved within thirty (30) days, with the exception of the reconsideration appeal which must be resolved within fifteen (15) days." FINAL COMPLEMENTARY PROVISION SOLE.- Adaptation of the Consolidated Text and the Regulations of Law 27444, General Administrative Procedure Law The Executive Power shall adapt the Consolidated Text and the Regulations of Law 27444, General Administrative Procedure Law, in accordance with the modifications made in this law, within a maximum period of thirty (30) business days.
