Law No. 28496 amends Articles 4 and 11 of Law No. 27815, the Law on the Code of Ethics for Public Service. It redefines a public employee as any official or servant of public administration entities and establishes the obligation for all public employees to report and the right of natural or legal persons to denounce acts contrary to the Code. Additionally, it mandates that all references to "public servant" in the Code of Ethics Law be interpreted as "public employee" in accordance with Law No. 28175.
LAW NO. 28496
THE PRESIDENT OF THE CONGRESS OF THE REPUBLIC
WHEREAS:
THE CONGRESS OF THE REPUBLIC;
Has enacted the following Law:
LAW AMENDING LAW NO. 27815, LAW ON THE CODE OF ETHICS FOR PUBLIC SERVICE
Sole Article.- Articles 4.1 of Article 4 and Article 11 of Law No. 27815, Law on the Code of Ethics for Public Service, are amended, which shall read as follows:
"Article 4.- Public Employee
4.1 For the purposes of this Code, a public employee is considered to be any official or servant of the entities of the Public Administration at any hierarchical level, whether appointed, contracted, designated, of trust, or elected, who performs activities or functions on behalf of the State service. (...)
Article 11.- Obligation to Communicate or Report Acts Contrary to the Code
Any public employee, under responsibility, has the duty to communicate, and the natural or legal person has the right to denounce, acts contrary to what is regulated in this Code, before the Permanent Commission for Disciplinary Administrative Processes of the affected entity or the body that acts in its place."
COMPLEMENTARY PROVISION
SOLE.- In accordance with what is provided in this Law, any reference to "public servant" in the Law on the Code of Ethics for Public Service, Law No. 27815, shall be understood to refer to the new denomination of "public employee," according to the Framework Law on Public Employment, Law No. 28175.
THEREFORE:
Having been reconsidered by the Congress of the Republic, insisting on the text approved in the Plenary session held on the twenty-eighth day of October two thousand four, in accordance with what is provided by Article 108 of the Political Constitution of the State, I order that it be published and complied with.
